    Thank you, I'll definitely do this today, as marston have said that they are coming around today at 6 unless I make full payment..

      Ok, I'll definitely be going to the courts today, would this stop or put on hold marston coming? I'm sorry if I'm asking question you may of answered but this is the first time I have ever dealt with the bailiffs and this has got me on edge...

          Well according to the bailiff I spoke to that they can have a locksmith and force entry so I'm not 100% sure if this bailiff is looking to scare me and trying to get a payment out of me asap.

            They might well be, but they can get a warrant to break in, so you must take this seriously and deal with it urgently.

            Otherwise you are being punished for a crime which you say you didn't commit.

                I posted early on a link to soliciotrs who give an initial free consultation - have a lok at it!

                Definitely get your magistrates court.

                The bailiffs are right that they could break in, but you will also learn that bailiffs lie a vast amount of the time, so just because they say they'll be there at 6 does not by any means mean they will. They bully and frighten you to try to make you pay.

                It is unlikely they will use the power to break in, and they would not remove goods on first entry, they'd levy on them (make a list of them. The goods then belong to them, but remain in your house for the time being). If you have proof they are not yours get the proof ready or do a statutory declaration at any solicitors saying they're not.

                On return from the magistrates court you need to get on with this bit in case they do come.

                  Just an update, I've been a busy bee today. I've gone to the magistrates and the crown court both have issued me with two forms. After some calling around and speaking to a fine enforcement officer and told them about the whole sitution and about the bailiffs, they have put a hold on the warrent for two weeks, so now I have to send a appeal out of time form to the crown court and get the grant to an appeal :-) I'm much more at ease now and thank you very much for advice. It's the best advice I've had. So now it's to get this form done and fax it over to them and get my name cleared of this badness!! :-)
