  • pressure from rundle & co

Hi i've been paying £10 a week on my council tax arrears on a 18 week tempory agreement to the baliffs as i've recently lost my job now the the council and baliffs say i have to allow them onboard my boat that i live on or the wont allow me to make payments and will want all money now. They claim to have levied my boat which i live on a car i dont own and a tv they have seen through the window. They have never been on my boat should i allow them on so that i can keep making payments or does anyone know of another option ? The council wont help anymore.

Are you up to date with this years Council Tax, and is there a Liability order for the arrears you are paying?
Who did you make the instalment arrangement with, the Council or the bailiffs?
You do not have to allow them into your home and it is wrong of them to say that you cannot make payments if they are not allowed on. They cannot levy on your boat, as it is your home, and anyway if they have never gained peaceful entry they can't levy on any of your possessions either. Who owns the car that they have unlawfully levied on?

Have a good read of this Bailiff Guide - Legal Beagles Consumer Forum

Hi i no longer pay council tax as you dont need to if you live on a boat. I think there is a liability order however i'm still fighting to get copys of any paper work on this. I'm not sure who owns the car they claimed it was levied in a public carpark next to where i'm moored which is strange as there are often upto 200 cars in there and i dont even have a driving licence. I made the tempory agreement with the council but they're now saying they will have no more to do with it. They only allowed me the tempory aggrement because i spoke to my local MP. Thanks for your help

You need to phone the council and ask them the amount of the Liability Order. Once you know this we can move forward. Wendy is absolutely correct, they cannot levy on your home, nor can they levy on any goods seen through a window. Do not let them on your boat as they have then gained peaceful entry and would be able to force entry in future.

The only problem I can foresee with you living on a boat is that normally after a visit has been made the bailiffs have to post a card through the letterbox detailing a range of information. Presumably you do not have a letterbox, so how exactly do you know if the bailiffs have visited?

Anyway, found out the amount of the LO from the council and then we can take it from there.

they normaly send any copys of paper work to my careoff address. Even though they claim to have levyed items they claim they want to enter to do it again can they keep levying as many times as they like ?

It might also be worth seeing the MP again if he/she was helpful before

They can't levy on anything inside purely by seeing it through a window. If they have done so, the levy is invalid.

As the boat is your home now it is imperitive you do not allow them entry.

It's off topic for your thread, but I'm becoming interested in living on a boat and would like more info about this
