i looked outside one day and my car was gone, i had no clue to where it had gone and eventually called the police, who informed me that bailiff have taken my car and gave me details to call. however, i had absolutely NO previouse contact from these bailiffs, no letters, no visits NOTHING. just out of the blue sky they took my car. i am aware that it is a legal requirment that bailiffs notify you of there existance and plan of action. now they are demanding 700 in bailiff fees. i said i am not paying becouse they basically stole my car as they did not follow correct proceedings! please help, what is the next step? they are definetly wrong and even the council have said what they did was illegal. the police wont get involved. thanx

Re: newlyn bailiffs have ILLEGALLY removed my car
they took it for parking tickets, that were suppossed to be in dispute, but i had not recieved a reply from the council about my representations which were all recorded delivery. i then called the council to question why i hadnt recieved a reply and they told me to call the courts, which i did but its all machines. so it shouldnt even have got to this stage. they are asking for 1500 now all together, sorry i posted this post again but in better detail. thanx amy

Re: newlyn bailiffs have ILLEGALLY removed my car
ok great, thankyou so much for that information, i have read the all the information and i am sure of my next steps. my plan is to file a Statutory Declaration, Out of Time (TE7)
and with a Witness Statement (TE9). hopefully it is accepted though i see no reason why it shouldnt be. does this form stop the thieves from selling my car?

It should but it probably won't.
You may have to sue the bailiffs to render up the vehicle in their bailment or the replacement value thereof; were you to win, seek a "forthwith" judgement which, if they don't pay, you could enforce by means of bailiffs having first told various tabloid "newspapers".
