  • equita and bailiff removal letter

my friend had a bailiff letter in May regarding a parking ticket that she had not paid,
The letter did not state how much only that they had called at her home to execute a warrant issued by Norhampton CC. and if not contacted within 24 hours will have no alternative but to reattend the property at any hour of the day or night.and will result in a £140 extra cost.
She contacted them and as paid 3 payments of £40 so far. The cost the bailiff is charging is over £300. This does not sound right to me and I am wondering if she can dispute this.
At the moment she is paying because she is a very busy lady and does not have time to deal with it.
    Any help would be great

Has she asked them for a breakdown of the fees?

no I spoke to today apparently this is the first she had heard from them do she teleohoned them and was told that there was 2 pcn both at £360 each or around that figure. They said that if she arranged to pay the first one quickly at £41 a week when it was finished they would only charge her £120 for the other ticket.
She was unsure exactly the price, but has now paid 4 payments of £40.

Did she know about both of the PCNs?

she knew that she had the pcn but did not get round to paying them. Then the bailiff letter came with no information on it so she rang them and that was was she was told and now she is paying them £41 a week until it is paid then they will discuss the other pcn at a reduced rate

she knew that she had receceived parking tickets but did not get around to paying them then received he bailiff notice with no information on it regarding the pcns so rang them and started to pay the £41 per week for 1pcn when it is paid they said she could pay the other at a reduced rate

rang the bailliff on behalf of my friend to ask for a breakdown of his charges. He said that he was in the car so he could got give them to me that She would have to write. He confirmed that she had 2 pcns and that he would reduce the second if she paid the first quickly.
I told him that he was in breach of the code of conduct, that she had only received from them the baillif removal notice with no information about the debt in question.
I told him that she had made 4 payments and until she received the breakdown of charges that no more money will be payable.
He then said that he could not be responsible if another bailiff visited the property.
I then made him aware that our conversation was recorded and then the phone went off.
The original tickets were for £35 if she only received the bailiff note how much should she be paying the bailiff.
            your help much appreciated.

equita have still not given me the breakdown of the charges but have sent me 2 letters dated the same date one letter requiring £125.44 inclusive of statutory fees of £11.20 by return of post. no penalty charge notice no. only car registration.
The other is a warning notice saying they have called to remove goods and that they will return in the next 7 days. I have made 6 payments of £41 pounds now shall I keep on paying them and what if they clamp my car.

Have you asked formally for a breakdown of charges or have you merely asked nicely?

When did you buy the motor-car from your friend?

Arguing semantics about the vehicle's ownership, helps who exactly?

Apart from obviously helping the bailiffs it might help to establish if the PCNs had been incurred by the OP or his/her friend.

The letter to Equita was a request for the breakdown of the charges including computer screenshot. not a SAR under the Data Protection ActS7 1998 so does not incur a fee of £10. And the are obliged to provide this information. That the abritary figure which was told over the phone is not mentioned on the Bailiff Notice. That they are in breach of the Code of Conduct'

When you are up against bailiffs, a code of conduct does not really count for much, as you have found out.

You would be much better off sending a formal SAR, that they cannot not answer - there is a link to one you can use in the bailiff guide.

I telephoned the council and they have just told me to telephone the bailiff office and if I get no satisfaction to write into them by means of a complaint.
If I also phone the Northampton Bulk Centre to find out if there is any warrents issued. would they be able to tell me.
                              many thanks
