  • Help! A bailiff levied distress on my HP vehicle on his first visit today

    Please excuse If I sound like gobblydegoo, I worked a night shift (Nursing) and havent slept.
    I have x 2 parking tickets outstanding due for payment, and have been to CAB to arrange instalment offer, however today a bailiff spent an hour trying to harrass me out of bed and then dropped x notices of impending seizure through my letter box , the usual first notices requesting the fine and not too inflated fees much to my surprise :tinysmile_aha_t:but with these he had also included a notice of distress against my vehicle, my HP vehicle this included an enforcement charge of 150 pounds the levy however looks approx correct
    Including all the fees and VAT the total sum demanded was £468, then I looked out of my window and saw my car had been clamped and smothered with the red warning sticker tht it was under distress.
    I have contacted and spoken to both the council and the bailiff the council were denying theyd been told to seize my car after I expalined this was illegal as not my goods to seize, however I have paid the bailiff £300 toward the total amount and they have removed the clamp, I am due to pay the balance in two weeks. I have no issue paying what I owe but aside from the fact they levied distress on a HP vehicle My main question and concern is wether or not they can do this on a first visit to collect money and wether the enforcement charge is in fact liad down in fees they can apply as I cant see this anywhere.
    So sorry to witter, but Id greatly appreciate any thoughts, I hope to find out where I stand prior to the remaining balance becoming due,

      Hello Amy, Thanks for taking the time to reply,
      Yes I've read the guide but I'm not clear that a bailiff
      Can levy distress on a first visit? As They gave no time
      Themselves for me to pay them first, I am clear they can't levy on an HP vehicle,
      But I can't find Any references to wether the enforcement charge is legal,
      I will be taking it up with them but just trying to find out where I stand on complaint grounds first
