  • Bristow & Sutor Council Tax - Help please

    Hey! I am new to the site so hopefully I posting this where it should be.

    I was wondering if anyone could help me please.

    I got behind with my Council Tax and it went to court they they got liability order.

    I have a actually moved and I did email them to say I had moved and would it be possible to for a couple of months to get myself settled in find a job etc. I got an email back basically saying no and to complete a questionnaire. I completed a questionnaire and I also wrote them a letter stating that I am sleeping on my sisters sofa, currently looking for a job and I am not entitled for any benefits for at least 6 weeks as I left my previous job.

    My sisters neighbour came round today as they has actually posted a letter through his door, which basically says they are try to contact me and wanting full details.

    I am not sure what to do next, I have no income at the moment and I dont want them letting themselves into my sisters house either.

    Any help would be greatly appreciated !

    You need to start by reading this guide, if you have not already done so Bailiff Guide - Legal Beagles Consumer Forum

    Since you are now living in someone else's house, then there is even less that the bailiffs can do.

    How much do you owe? We need to know the actual amount of council tax you owe rather than the amount the bailiffs say you owe.

    Have a read of the guide and come back any other questions if you're still unsure.

      Thank you ! I will have good read through this.

      I am not sure on the exact amount but its probably around 1410.18. I am trying to get an exact amount.

          I phoned the council a week ago and they said they would send it in the post however a week later I havent received anything, I have contacted them again chasing this up

              I now know the outstanding amount its 1668.04. I emailed B&S at the weekend about the letter sent to the neighbour and they replied saying they handnt contacted them at, which i replied to say I would send them the letter. I have had an email from them today saying sorry I was mis advised and yes they had contacted them to check whether I was living there or not. They have also stated that if payment is not made they will come round again to my sisters but just for a chat of proof I am there, even though I have said I am staying with my sister and my sister has also done so.

                Has this amount come from the bailiffs or the council? If it's the former, then it's simply not good enough.

                You need to have the outstanding amount given to you by the council.

                  To echo the sagacious advice from Amy of the Lovely Legs, get the sum owing from the council rather than the bailiffs.

                  That's the other thing about bailiffs - they can be remarkably stupid; by admitting having contacted your neighbour to seek details of where you reside, they would appear to have contravened several guidelines and/or regulations, not to mention the Data Protection Act 1998.

                  It would not matter what - if anything - they gave as their reason for seeking those data, as a quick Google search for their name or address would reveal the nature of their business and hence the reason for their (improper) request.

                  They have also stated that if payment is not made they will come round again to my sisters but just for a chat of proof I am there, even though I have said I am staying with my sister and my sister has also done so.
                  Do not let the oaf in under any circumstances, regardless if he claims it is "just for a chat" or states that he will not even try to levy distraint on goods.

                  Always remember: bailiffs tell lies.

                  It doesn't matter if he claims he needs to 'phone head office, or if he's hopping from one leg to the other whilst claiming that his bladder is about to burst - do not let him in. as bailiffs tell lies. If he needs to 'phone someone, you may direct him to the nearest payphone whilst, if his bladder is "literally about to burst", offer to film it so you can post it on YouTube.

                  It has even not been unknown for a bailiff to fake a heart attack to gain access to property though, coincidentally, there is one known condition when bailiffs do not tell lies and is evidenced by cyanosis of the lips and sustained cessation of breathing.

                  It's when they are dead.

                      True, but it doesn't state when bailiffs can be relied upon not to tell lies.
