    A removal notice for my partner was hand delivered yesterday by Marstons. It is for £90 fine issued by the magistrates court for a driving offence. They have added £75 compliance fee and £200 attendance fee. Is this legal or can they only charge £24.50 for the first visit and £18 for the second? Also if he pays the fine to the court can Marston still come after him or is the debt cleared? We havent had any contact with Marstons yet just wanted to get some advice first.

    The £24.50 and £18 visits relate to the collection of council tax debt.

    Yes, he can pay the court and the debt will be settled, but you should be prepared for a fight with the bailiffs because they won't just give up.

      Thanks Amy, he has paid the debt with the court online. Shall he ring Marstons and tell them this? What is the best way to deal with them? Where does he stand legally? Can they still gain entry? Lots of questions I know, sorry. Thanks

        Ignore them. Completely.

        Make sure you get in writing from the court that this is paid and if Marston persist, send them a copy of the letter as proof.

        I know it's worrying, but it's paid now and Marston haven't been paid so they will kick up, but there is nothing they can do and no they cannot break in.

              Hi Amy, the court has returned the payment and said to get in touch with Marston, what is the best thing to do now? shall he ring them to arrange payment with them?

                do they have to give you a certain amount of time to pay or can they demand it all?

                  They have to have recovered the money within 6 months.

                    The court returned the payment by cheque. He has spoke to Marston who said it was an attendance officer who posted the letter and to wait till the bailiff gets in touch and then speak to him. We were just wondering if they have to give you a certain amount of time to pay or if they can ask for it all in one go.
