    can ANY ONE ADVISE ME please,, 19 months ago my friend parked on double yellows,, thought he got away with it i guess, moved house, but also failed to notifie dvla of change of adress and worked abroad a few months, moved severla time on return to uk.... long story cut short, Friday he was served with court papers from northampton court baliff Marston Group and for a £30 parking ticket, the courts couldnt find him so gave it to dedt collectors,, and if he doesnt pay in full £2106 by this friday they will take his car,,, he needs car thats on finance for work,, and hasnt got that sort of money,,, he didnt even know they were looking for him,, he spoken to them, but no help,, or even part payments,, and courts says nothing can be done, and its down to the company as they now got the debt,,,he really cant lose car as he needs to work, yet no one can help,,, friday coming round so fast,, please is this legal ????,,, and has it got to be paid in full,,,,, he was parked in reading when he got ticket,,, any help please,,,

    Who was the original fine from?

    Has he provided proof that the vehicle is subject to finance? If not, he should do this immediately.

    They cannot remove a car that does not belong to the debtor and if the vehicle is on finance, it doesn't belong to him. If, on the other hand, the vehicle was bought with a personal loan, then this is different entirely.

    Has he asked for a breakdown of the fees charged, if not, he needs to do this as soon as possible. You should have a read of this and send the SAR contained within Bailiff Guide - Legal Beagles Consumer Forum

      hi, and thanks,, reading parked on double lines , not sure who but had parking ticket,, and they say its run that high because it took 19 months to find him,,, and council sold debt on to marsdons,, am trying to get hold of him to get correct details

        they told him it didnt matter if car on finace,, they will take it and hold it untill he pays it,, they wont sell it,,,

          Have they already levied on the car?

          Has he been visited by the bailiffs?

          Has he signed anything?

          Has anything been posted through his door?

          What kind of work does he do and would it be possible for him to use public transport if the car were removed?

            first he knew about this was friday,, they said they will return friday for payment,, and if not they will remove car... thats the bailiff,, so yes he been visited,, they want full payment,,wont except any part payments, said there was a warrent of arrest issed jan last year,, but took them this long to find him,,,he travels from office to office so yes needs car,, too far for public transport,,, is there any way of reducing this ,, so high for a small fine

              ys they asked him to sign to say thay called and will be back,,, he stil got car at moment, but will be taken friday ,, told not to sell or hide it

                You, or rather he, will have to send the Subject Access Request in the link I gave you earlier and add a sentence in to ask when Guildford Council decriminalised their parking, but since the claim came from a County Court, they are lying about an arrest warrant.

                  no nothing,, he in rented house,, only got his car,, nothing else,,and yes they came in ,,,, he boards in house,, rents a room,,, nothing his there

                    so Amy,, what do you advise friday,, take the car,, or try and riase money to pay them off to keep car, and then try and get it refunded ,, help please lol

                      Move the car and don't answer the door. Send the SAR immediately to ascertain how the fees are broken down.

                      Then have a read around this forum, searching for 'fraud' - because these fees are definitely fraudulent.

                        ok many many thanks Amy, will pass on all info,, but got feeling , he will try and get loan, as he cant take a risk with his job,, and needs car to get there, so then he will have to make claim to get a refund,, am sure thats why these companys do so well,, its the sheer fear they give to people,,over £2000 for a silly parking fine,, so unfair,, but thanks you so much for helping

                          You're very welcome.

                          If he wants to go that route, then make sure you send that SAR and get a refund on the fees because he'll be paying around £1500 over the odds.
