had a bailliff letter asking for £100 pound for a parking fine...original fine £80. Bailliff came to my house while i wasnt at home, i rang him up and paid the £100 by debit card. he then said i owe a further £200 for removal van charges.:tinysmile_aha_t: i asked him why he'd sent a removal van down when i know that i don't have to let him into my house, so a removal van would be pointless. He replied by saying he came down to take my car. How would he put my car into a removal van????? he then got bored of me and passed the account onto another more persistent bailliff :beagle:who arrived at my house at 8.37 this morning saying i have 24 hrs to pay the £200 or he will take my car. he handed me a walking PO which i have not signed. my car is on its last legs anyway and i dont think it will get through nx MOT due in March. my other half has gave me some money to buy a new car 2 put in his name!!!! and i want to trade in my old banger as PX, can i still do this legally as i havent signed the WPO and i would rather use the money to buy a new car rather than give it to them parasites and keep my old loyal banger. on way to do this tomorrow, what wud be the consequences??? advice please!!!! thankyoooouuuuu xx:tinysmile_hmm_t2:

Just write to the council responsible for the ticket explain the situation refuse the Bailiff entry unless he has a court warrant

You could write to the Bailiff company and quote the following which may scare them away.

As for your right of entry: Under OFT guidance, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).

Therefore take note that I revoke license under Common Law for you and/or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited police attendance if need be.

Further if you wish to take the step of obtaining a Warrant I require under Civil Procedure Rules that you inform me by return in which court you will be making this request as I intend to present a defence. Further I will be requesting that the case is allocated to the county court in 'your home town'.

thankyou for that, ive just read that the baillff can take my new car even though it is in my spouse's name. is that right? i dont think it is? the bailliff hasn't returned since though. think i better park my car over the road to throw him off scent, just incase that information is correct

No, this is not correct. He can only take goods that belong to the debtor ie, you.

Have you requested a breakdown of how this £200 is made up?
