  • bailiff dispute

    agreed to pay bailiff by 28 feb. however have since found out warrant issued on 2 oct so 180 days takes us to 29 march. bailiff says i cant have extension on arrangement. also fines office ar Banbury have confirmed Marston have applied for an extention on this warrant and have till the end of the year to collect monies due. does this extention apply to me.Marston deny there is an extension on this warrant. bailiff states if i dont pay as agreed enforcement will be made anyone any ideas:tinysmile_cry_t:

      a warrant is only valid for 12 mths, so are you saying they can ask for an extension. what are they after you for, is it council tax or parking fine etc ??????

        A Distress Warrant is only valid for 180 days.

          only one set of bailiffs involved Marstonand warrant for no payment of fines. warrant was issued on 2nd October 2010. however the fines office has stated Marstons have requested an extension and they now have until Dec2011 to collect this money. Marston deny this. however if warrant is issued on 2nd October does that mean i have until 29 march to pay the balance. bailiff say i cant cos i entered into a verbal agreement with him to pay by 28 feb and i must pay by this date. hope that clarifys the situation.

            If the warrant was issued in October they have 6 months in which to collect the debt and the oral agreement you may or may not have agreed to is irrelevant unless the bailiff can prove you made such an agreement with him.

            Since this is a magistrates' court fine, you do need to be very careful.
