    hi, in august 2007 had court fine for careless driving. fine was £450 paid £100 and then lost my job. court agreed to deduct £5 out of my benefit.but before this was set up returned to work and in october 2007 sent bankers cheque for £350. last month got bailiff at the door demanding payment. court says chque was never received. bailiff wants full payment by end if February which i agreed to but stuggling to get the money together as fine is now £625!!!! do i have 180 days to pay this fine or not . any advise pls

    Well if i were you I would check wether the bankers cheque had ever been cashed. If it hasn't, then surely you could get a new one raised, as presumably the money will already have been deducted from your account to pay for the first one, so if it hasn't been cashed then you would be able to get a new one?

    Did you not have any paperwork/correspondence from the court (or anyone else) prior to the bailiff turning up?

      no cant check that. bank account was closed soon after and bank no longer has records. i did have a letter in the prvious november but Marstons couldnt tell me what it was for!!!! told them to ascertain the facts and get back to me. no contact and eventually th ebauliffs are at the door. he said they had been trying to contact at my previous address but no communication was recieved by me.

        Bank no longer has records? It's only 3 years ago - why haven't they got records? And it would be records of their account as well as yours, i.e showing the money for the bankers cheque coming out of your accounts, and the actual cheque coming out of the bank's account. I cannot believe that a bank doesn't have it's own records from 3 years ago. I'm sure they are supposed to keep them for at least 6 years.

          I believe it'ssix years after the last transaction . Send then a subject access request with a statutory £10 payment . Specifically ask for all records of payments , cheques etc.
