  • jbw bailiffs

    in dec 2010 jbw came and took my car from my present address said it was for a outstanding pcn april 2010 but i had moved in feb 2010 told jbw but they still took the car i filed for out of time with tec but that was rejected so i filed for a n244 in the meantime i wrote to my mp and she wrote to southwark on friday 4 feb got phone call that jbw was returning my car alls well.
    when i got car back there was locking wheel nut missing electric wing mirrow not working both had been pushed in and when the car left me it was locked but when it came back drivers door was unlocked. what can i do
    also on tuesday 8 feb 2011 got a letter from my mp wich southwark had sent to her saying that when they got my car at new address what should have happend jbw should have sent the warrent back to southwark then they would have then reregistered the case with tec at the new address so southwark said due to this procedural error by the bailiffs they will cancel the pcn and no further action will be taken.
    all i want to know is do you think i could claim for the stress and gain back money i had to spend to get my children to school and cab fairs that i had to pay going shopping hope to here from you soon chopstick

    So I take it your N244 has been accepted?

    If it has been accepted it means that the warrant has been revoked and you are entitled to be refunded any fees that you paid due to having a warrant issued when instead it should have been returned.

    What stage is this at now? Have you paid the original fine? Have you been repaid any fees?

      never had reply from the court about the n244 it was southwark that told the bailiffs to return the car to me no charge because the bailiffs had not followed procedural if they had the warrant would have been sent back to southwark for the pcn to be sent to new address but the bailliffs took the car anyway i just want to know if i can clam for the damage to my car and compesation for the cost in the last 2 mounths of not having my car thanks chopstick

        Are you saying there is now no longer a PCN to be paid?

        What proof do you have that it was the bailiffs who damaged your car?

          i have in a letter to say that the pcn has been canceld and no further action will be taken.
          but as for the car when it left my address all doors were locked wing mirrors where out when i got the car back before it was taken off lorry i had a look at car this is what i found
          1 locking wheel nut missing and tyre was flat and it is bald sure it has been swapped.
          2 wing mirrors pushed in because of them being electric they should never be pushed in manually out cum of this is drivers side mirror not working properly .
          3 also drivers door was open and it was locked when it left my address and i had both sets of keys that means someone has been in my car
          and can i claim composition

            Since you have managed to get the whole PCN cancelled, I would say it is well worth an attempt.

                Out of interest, can you post up the wording of the letter where it states the PCN is cancelled and who is it from?

                  it is headed letter from southwark council and the correct wording is as follows

                  i have therefore instructed the bailiff to arrange to return mr d****** vehicle.due to this procedural error by the bailiff i will be cancelling the pcn and no further action will be taken

                        You can hit them with a claim for restitution. you will need to provide proof of the value and condition of the car b4 it was taken and also what the condition was after they returned it. The chairman of jbw who is mr jamie waller likes nothing better then to squeem like a bay in court. also you should have southark on your side as well. Do a claim against both southark and jbw.
                        If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them.
