    Hi there,Im in need of some pretty urgent help like i only have a matter of hours they informed me.Please bear with me as we are in abit of a flap so i will try make it make sense.Sorry in advance.

    **(afternoon)31st-Jan 2011-
    Was in the shower and heard what sounded like someone knocking my door through went down to see
    FINAL NOTICE - Client HMCS Mcr
    Enforcement agent- Mrs Maidment
    Balance-£450


    I emailed Marston via there own website and rang the court who both was unable to assist me on this matter.I didnt contact the agent i just tried to find out who she was.

    ** (Morning) 3rd Feb 2011-

    At 7.50 am as me and my wife was getting the children ready for school we heard chains being pulled to which by the time i unlocked the door they had clamped our car with stickers all over it and not a single sign of the people.
    The letter posted through the door states;

    NOTICE OF DISTRESS- SECTION 58 MAGISTRATES COURT ACT 1980 AND TAXES MANAGEMENT 1970
    SUM OF £450 FOLLOWING A CONVICTION ORDER OF THE COURT 20TH SEPTEMBER 2010
    ATTENDANCE AND REMOVAL FEE £150
    TOTAL £600
    SIGNED BY MRS MAIDMENT.


    Please help me im full time carer to my wife who has mental health illness,We also have 3 young children being 8,12 and 5 one of which has SEN and under CHAMS. We live on disability living allowance and are struggling with everyday living bills.
    My wife rang Mrs Maidment to which she had a full conversation with the officer despite it not being in my wifes name she started it was tv licencing and that we had till 9pm to make full payment.

    Can i stall them breaking in??? ive never had any kind of formal paper work from court handed to me at any time to even chase this up

    No paperwork at all for this? No reminders, no nothing?

      My wife says i am one (the username).
      The only paper work was at the time when they knocked and gave me the form for no licence and possible going to court but nothing that stated actually being at court.
      On the Register the Mrs Maidment (the only1) her 1st name should be lindsey and it states Altringham court on it if that makes any difference
      The licence now is payed by payment scheme.
      Can i print a letter and post it to the court and give the bailif one to stall it to give me chance to seek legal help.

        Just a thought ive just been reading the walking posession agreements do i let them take my care despite its how i take my children to school and we had to walk 3miles in the rain to get them there this morning.Or do i ring the woman and ask her for some time to get to the CAB

          I've faced off HMRC once on distraint, however I received a warning from them on they're intent.

          Attached is info on this process as I think this is the power they used in this case.

          I'd advise going to your local CAB and send an email to your MP laying out simply what happened and your circumstances. I did this and it had a wonderful effect on HMRC as they dumped any talk of distraint

          Ask the court for copies of the Judgement that was handed down.
