    Hi

    Just wondering what happens after a Bailiff fails to gain entry to execute a distress warrant for Council Tax. I have not opened the door and not called the number left on the letter to make any arrangement.

    I tried speaking to the Council who forwarned me that it had been passed to the Bailiff and refused to enter into any arrangement with me.

    Thearrears were causd by a breakup of a relationship that had accessed my bank account and left me £50k plus in debt before I realised it and changed banks.

    If this warrant is returned to the council will they talk to me to make an arrangement or what will happen. I do not wish to have an attachment to earnings as this will put my agreement with the DMC at risk if I cannot keep up the payments with them.

    I will admit that my handle may give you the idea that I have by just disappearing from the UK

    I don't really know much about these issues, and sure someone will come along to give some good advice on this soon.

    I take it you already tried seeking help from your local Citizens Advice?

          Hi R2R,
          I think if you want to stay on the right side of your council AND avoid the bailiffs then you only really have one course of action.

          You need to start paying the council direct either online or via their automated telephone number. You need to pay a fixed amount regulary (a smaller amount weekly is better than the same amount monthly) so that you establish a record of paying them.

          There is absolutely no point talking to them at the moment because all they will tell you is they cannot take payment and will refer you to the bailiffs. Continue to totally ignore the bailiffs and under no circumstances let them into your property. If you have a car parked outside or on a driveway I'd move it a few streets away as they will levy it given half a chance. If they do turn up either just pretend you're out, or if you have to talk to them, do so through the letter box or an upstairs window.

          The difficulty here is the time of year as in two months a new Council Tax year starts. Ideally, if it is feasible, you want to have cleared tihs years arrears by the end of March. If this is not going to be possible pay what you can now, but you'll need to write to them before the end of the financial year to explain how you intend to clear the debt.

              Hi everyone who answered.

              I is not my intention to default, but when you finish up with a £50k debt through no fault of my own what can I do.

              I cant make weekly payments as I get paid 4 weekly so it will have to be every 4th week.

              Anyway, thanks for the info, appreciated.

                Hi again R2R,

                I'm sure this must be able to be resolved. Running away is not the answer as because it's public monies the debt will never become Statute Barred.

                I only suggested weekly payments as it builds up the repayment record faster - in two months you'd make 8 payments rather than 2 which looks better on paper. You can always put the money aside and then pay a quarter in weekly!

                Regarding the bailiffs you could really do with Amy's advice as she is the expert in this area. Hopefully she'll pick up on the thread later on.

                  Dont know if this helps you but because of redundancy I ened up with bailiffs demanding council tax PLUS huge costs added by the bailiff. I wrote and asked the bailiffs for a breakdown of the bill which they did send me. It included a fee for a levy which had never been made so I wrote a letter to them saying that as they had made unlawfull charges I would not pay them. I sent a copy to the council aswell and I started making payment direct to the council via my council tax payment card. A few weeks later I had a letter from the peeps at the dole office telling me that small payments were being taken from my jsa.

                  I consider this a win situation as its an affordable amount and THE BAILIFF DOES NOT GET A SINGLE PENNY

                  We all gota pay our bills but DONT PAY THE BAILIFF.
