  • Marston Group Distress Warrant

    I woke up today to find my car had been clamped at 7am with a WARNING sticker on the windscreen, I called Mr J Ford 4093 and he told me I owed £565.37 for a unpaid parking fine Dec '08 I said I dont recall this and how can I resolve the matter to be told "It's too late now, If you dont pay Im taking your vehicle" I asked Is that legal he replied " Got a warrant from Northampton County Court so yeah" I called the Police as I have never been In a situation like this before they told me " They are (bailiffs) Independant from us and do have the power to seize property" After hearing I thought I aint got no choice but to cough up or lose my car. I called the bailiff and agreed to pay he later turned up took the payment gave me a receipt and left.
    My car Is registered to me at my home address but was clamped outside my partners house, Is that dodgy? I asked how he knew the car was In another post code he said " camera's In vans drive around I must of got flagged up" how true Is this?
    The car was bought on finance and Is not fully paid off, does that mean anything?
    Could he still tow away and sell?

    VAT on Bailiffs Costs at Standard Rate £61.11

    Totat Amount Due Today £565.37

    Basically Im clueless about the whole Situation have I been robbed? Was I followed to my partners address I that legal? Can claim anything back? and has the bailiff broken any laws?

      Yes, this could be true. Some bailiffs use ANPR cameras, so in this instance he could be telling the truth.

      Yes it does and no he shouldn't have done.

      Since this is now paid you are going to have a battle on your hands to get anything back and it depends how serious you are about it. A lot of people say initially they are serious, but soon give up. It is possible if you are determined enough.

        Thanks Amy, how should I try to reclaim the fee's and will It cost me any money?
        Is he legally allowed to charge me £400+ on top?

          It won't cost you anything unless and until you need to file a claim, which might happen.
