    Good result, I'm very pleased for you. When it is returned, make sure you check it over with a fine toothed comb, bailiffs aren't known for treating other peoples' belongings with much care.

      My dad will be here in the morning, the bailiff wants me to give him the keys , so he can undo the steering lock etc where its being kept at, although he didnt mind getting it lifted and dragging it over the block paving last monday.. so my dad will go with him and do whats necessary, not handing over any keys !!

      He is also going to get it checked out by the MOT people who passed a few month ago..
      They should be able to highlight any psoible damage caused to the undercariage..

      I am not very happy I have to see the bailiff again anyway, dont trust them an icnh no more, will he try n get me to sign Ive got the car back, for it to be another walking possesion etc.. not going to sign a thing, but I wonder if he would bother any tactics?

        HELP REQUIRED PLEASE..

        I rang the bailiff this morning as he hadnt been back to me about returning the vehicle, he has told me it will be rutrned before dinner..

        Now this is the thing on the phone he told me..

        1) I am still getting charged for the removal of the car, its not an invalid levy because I signed the walking agreement in aug 2009. ( of which i wasnt made clear what it was as ealrier informed)

        2) He told me, with respect hes been in my house, and i havnt got anything worth selling (his words, no furniture ( we have!!) but I have never let him in the house, my mum let one in in sept 2009 for the previous years bill, but only in the kitchen where she was bullied into paying.. she says it wasnt him, it was a big bulky bloke..

        3) because of this he will send it back to the council with all the details and i will get arrted and a 90 day custodial sentence..

        4)I broke the law by signing the walking agreement in aug 2009 on a car that didnt belong to me, therefore im liable for charges,..

        Its a 7 minute conversation in which I ask him once again, so you are saying I will be arrested and sent to prison, he said yes..

        I HAVE RECORDED THE CONVERSATION..

        I would like any advice please, thankyou..

          Put pen to paper and complain to your council. As usual the bailiff is being economical with the truth.

            The removal guy from the auctioneer has just dropped the car off, he said Rossendales have been on to them since yesterday, trying to see if they would fetch it back for FREE !! lol, why would they be bothered if i am liable??

                  The guy said the bailiff wanted him to smash the window last week, but he refused.. he said he is only acting on orders but knew it shouldnt have been removed.

                  Regarding the Police, Ive spoken to them personally 3 times and my dad once.. Same rsponse each time.. as soon as bailiffs are involved they seem to have a automated response, civil..

                  I now want to find somewhere it clearly says I am not liable for the levy they imposed on a car, I made clear isnt mine, before they took it away..

                      This is totally amazing and if it were me I would be making a formal complaint. The Balliff may have had a right to seize YOUR car but they had no right to steal your fathers car. Thats what it is plain and simple THEFT.

                      Say for the sake of argument it had been a visitors car parked in your driveway and the Baliffs stole it would the Police have still said it was a civil matter.

                      If the car has been damaged by these theives is it Civil Damage or Criminal Damage. If tere is property missing from the vehicle is it still a Civil Matter

                        If you do make a formal complaint to the Humberside Police over this matter it will be one more in the collection. Also if you escalate it to the IPCC, it will be another one in their collection.

                        Apparently I'm the only one who has reported Rossendales for illegal levies.

                            What your dad should do is complain to his MP and make a formal complaint to the Chief Constable via a solicitor.

                              I emailed the council and rossendales yesterday to clarify to me was their bailiff correct in telling me I have to pay for the invaild levy on the car and its now going to go to court to get me arrested and a 90 day custodial sentence??

                              The council replied to me this morning with this..


                              I refer to your e mail of 1 February 2011 regarding your Council Tax Arrears .

                              I have today spoken to Rossendales Ltd and they have agreed to return the case that had been with them to North Lincolnshire Council with an appropriate distress certificate, which enables us to to take further recovery action.

                              I will accept a minimum arrangement of £12.50 per week with effect from 9 February 2011 to cover both the Liability Orders of 24 June 2009 standing at £482.15 which is to to be returned from the bailiff, and £374.00 on the recent Liability Order of 26 January 2011. This lower arrangement has only been agreed to on the proviso that you do pay next years Council Tax due from 1 April 2011 monthly as billed as you are currently not in receipt of Council Tax Benefit to reduce this charge further. The current balance on your account is £856.15 with the last payment of £8.45 showing on 26 January 2011.

                              I would however point out that should this arrangement fail we could still pass the Liability Order of 26 January 2011 to the bailiff , and also take further action on the Liability Order of 24 June 2009. Clearly if you can make any additional payments at any point to reduce this debt further , please do so. A letter has recently been posted to you about the Liability Order of 26 January 2011 which you can now disregard.

                              Ok, so the good news is the council has taken the debt back, although they they rossendales have agreed to return it.

                              However, apart from the 3 months of this years liability which was in court the other day, it says I owe 483.15 ( that includes the 8.45 direct payment, so in effect its saying Rossendales had my outstanding balance of £490.60

                              The initial libaility for 2009/2010 was £1070.80 , my total receipts to rossendales is £725. ( this excludes if I paid any online, which for some reason, I seem to remember I either did or maybe tried to)..

                              So this would make my outstanding balance £345.80 then minus the £8.45 made direct to the council last wednesday £337.35

                              This would mean rossendales have witheld £144.80 from the minimum £725 Ive paid them!

                              What charges are rossendales allowed to make for an invalid levy, they took my fathers vehicle..

                              Also they havnt answered my question regarding was their bailiff correct in saying I was responsible for the removal fees, of course they havnt added that on to the bill, but they havnt said he shudnt have said that.. Also they have answered if he was correct in telling me he will be returning with police to arrest me for a 90 day custodial sentence once the courst ahve told him to.. I didnt tell them yesterday I have recorded that conversatiopn..

                              So to me, they seem to have done it like they are now doing me a massive favour and I shud shut up now ans ensure I stick to the arrangement or it will be heading back to rossendales..

                              I personally think I am not finished with this yet, I have on a recorded telephone conversation their bailiff telling me I still have to pay the charges for the removal and the only really conclusion now is a 90 day prison term..

                              I dont like the idea that i have paid Rossendales 144 pound to have been treated like that, .. What should I do, let it be and move on or fight this??

                                If you've got evidence of a bailiff threatening you then you NEED to file a form4 complaint with the court who certificated the bailiff!!!
