    Rossendales are only Baliffs. They do NOT have the right to ask for the SORN. Only the police or DVLA can demand this.

      Yes but I know what they are doing, they are digging their heels in just to prolong it, I cant beleive they are doing this.

      But I have a long 2 hour drive to meet up with the previous owner later, I know i could get it faxed but I dont want to send copies or anything, it will be originally on the headed note paper his business is under, which is what is on the V5.. Plus I dont want to wait for postage.

      I will then go to the council and get them to do any faxing etc , .. Ive tried ringing both my local councillors and they are both unavailable..

      Id like just one of them to step back and see that I am not trying to avoid paying, I made a payment yesterday, even after they took the vehicle, I wouldnt be going to all this trouble had I did infact own the vehicle, becasue believe me, as skint as I am, id have sold that monster long beofre now and wouldnt have been in this bloody mess anyway..

      Are they still hoping I will give up and just think bugger it, let them have the car??

      Well in the unlikely event that happening, my dad wont and wants his car back..

      Fed up of being diplomatic and patient, they dont deserve any respect.

            As soon as the car was taken your father should have phoned the police and reported the vehicle stolen. By waiting around he isnt helping his or your case any. Let the Old Bill sort it and hopefully they will prosecute these legalised gangsters for Vehicle theft.

              You have no obligation to provide any more proof than you already have so I'm not sure why you would go to such extremes when all you need do is report the matter to the police.

              I also suggest you send a SAR to ascertain precisely what the £640 you have paid so far is for. Use this one Bailiff - SAR - Legal Beagles Consumer Forum

              If I were in your situation, I’d tell them to keep the car and I’d sue for the full amount plus compensation for the loss of my vehicle, but I understand how distressed your father must be by all this, so send the following (filling in the gaps) to Rossendales and a copy of it to your council.

              Dear Ms Green-Jones,

              Outstanding Council Tax at (address)

              I was visited by one of your bailiffs in August 2009. The bailiff did not enter my property and instead we spoke on the doorstep ostensibly to discuss coming to an agreement with payments. I gave the bailiff some details about how much I could reasonably afford and he ticked some boxes. He asked me to sign the form “just to say that we’d spoken”. Since I did not know any different I signed, only later to discover that I had been lied to and tricked and that I had in fact signed a Walking Possession Agreement listing a vehicle belonging to my father [provide registration number.]

              The National Standards for Enforcement Agents states the following “Enforcement agents must carry out their duties in a professional, calm and dignified manner. They must dress appropriately and act with discretion and fairness. Enforcement agents must not misrepresent their powers, qualifications, capacities, experience or abilities.”

              A bailiff may assume that goods belong to a debtor. However, when presented with solid evidence to the contrary no levy should be applied. Had your bailiff not lied to me in the first instance about what I was signing back in August 2009 this illegal levy would never have taken place and my father would not now be without his vehicle. I have shown your bailiff, Mr Crooks, a copy of the V5. He does not accept this as valid proof that the vehicle does not belong to me. He has now requested a receipt for the purchase of the vehicle together with insurance details, although quite how either prove ownership more conclusively than a V5 is beyond me. In any case, I have no obligation to furnish a bailiff company with these details and I will not be providing them.

              You should be aware that my father has now reported his vehicle as stolen to the police. If you would like the crime number, then please write to me requesting it.

              Due to my continued exasperation of Rossendales’ dogged defence of their actions in the theft of this vehicle, I have also sent a letter of complaint to [council] in particular the appropriately named bailiff, Mr Crooks.

              Take note therefore, that should my father’s vehicle not be returned by [give them a date] he will issue a claim for the full amount of the vehicle and his claim at that time will include costs plus an amount for distress and compensation. I will also file a Form 4 complaint against Mr Crooks.

              Finally, you should be aware that I will not be corresponding any further with you on the matter of my outstanding council tax liability and anyone from Rossendales visiting my property, other than to return the vehicle will be guilty of trespass. A letter to this effect will be sent under separate cover.

              Yours sincerely,


              Once you have done this, send Rossendales this trespass letter:-

              Dear Sir/Madam

              TAKE NOTICE



              That any visit to the above property post (add date of this letter) by yourselves, your agents, or those otherwise acting on your behalf or upon your instructions, stating either verbally or in writing an intention, unlawfully or by force, or guile (and other than by express invitation) to enter these premises and remove property, will result in the arrest of the agent/person concerned for attempted burglary. Steal shall mean any removal or attempted removal, or intention to remove, any property in which you have no lawful Title or Property therein.

              I reserve the right to produce a copy of this Notice to the Court in future proceedings.

                  You need to realise that the police don't really know any better, you must insist on reporting it stolen and you need a crime number - make them give you one.

                  Nobody can fix this except you, we will help you, but in the end it's down to you and you will not get that car back if you just roll over - they will sell it.

                    Many thanks for that template letter, I have shown my dad and he has agreed thats the way to go. Well we are geting that receipt posted anyways, but Im glad you have put that.
                    We shall get that crime number!
                    Its just a concern when you read that the onus is on me to prove I dont own the car, so thats why I was trying to get the receipt etc, because I didnt know where I stood if they sell the car and they say I refused to show them further proof??

                    But your letter clearly states I have given them enough. Its just woithout knowledge, you start beleiving what they say to you,

                    Mr Crooks is the man who the fax was sent to by the council, so is he now the main bailiff I am complaining about and not Mr Woollas at all, who was the bailiff at my house?

                    Do I adress it to Sir /Madam?? or is that name actaully someone real?? sorry if it sounds like daft questions, my head is a bit frizzled but , yet my determination is still solid !!

                      Letter done and ready to print off and post recorded delivery in the morning.. just a couple of very quick questions,

                      1) I am not sure if Steve crooks is a bailiff, he works at rossendales and was who the council recovery department faxed the v5 to.. so do i still refer to him as a bailiff.. is the complaint to him soley regarding him not accepting the v5 as proof..

                      2) it says ive sent a complaint to the council, is that in fact this same lettter, as im sedning them a copy, is that the actual complaint letter??

                          Oh I know it was written specifically for me, but becasue all I had to do was fill in the gaps, thats why i called it a template !

                          Plus the other question related to Ms green-jones, but now realise shes the MD of rossendales..

                            did you report it to the police yet . I would suggest you SAR your council immedealy, ask specificaly for all notes calls and paperwork around this CT. charge. Sar the baillifs ( both you and your dad ), they will say £ 10 bla bla and then just respond by asking how much paper is involved, you will get it for free

                                CAR BEING RETURNED !!

                                Thankyou everyone for your help and advice. I decided to let this whole stressful situation take a back seat so I could just try and enjoy my weekend,

                                My father did ring the police Thurs night and he was told its a civil matter, I know the advice was to take the number and report to the IPCC but I instead decided to wait until the receipt arrived in the post from the previous owner.

                                I emailed the council, bailiffs and the council chiefs telling them that on Monday morning I am going to the Brigg Council office with the V5, receipt off the previous owner who is on the V5, a statement of ownership from my father, informed them the SORN for insurance comes into effect April so not only can the police or DVLA not insist on it, they are in fact the only people who would be able to even if it was legislation!

                                Finally, I received a phone call from the bailiffs saying they have done the release documents, Ive contacted the original bailiff, he said i could pick it up now, but as its not insured, he is arranging it to be dropped off today or in the morning..

                                he is to ring me back..

                                So its finally done, I know alot of you will still fail to know why my father didnt try and ring the police before hand, but Im glad we manged to get it sorted without the need.

                                I was adamant I had sufficient proof to prove it isnt my vehicle, which was the key to the whole thing after all..

                                But I shall be using this site once the car is in place to pursue paymnets I believe the bailiffs havnt paid to the council off my debt, plus the charges they have imposed..

                                Thanks to Amy, I didnt end up needing the letters etc, but the knowledge given that I had rights , gave me the positives I needed..
