      I have informed the council I have sent a "Before Action Letter", with copies to the CEO and the leader of the council, so would like to sort this, I have other issues I want to pursue!

          Well once the vehicle is returned i shall be doing an SAR, as if you add up what I have paid to the current outstanding balance, there is a discrepancy of approx £400, which considering they have an invalid levy, it is way too much..

          Plus the year before, unfortunately Rossendales got involved for a smaller amount on my council tax , which was paid there and then , which was quite a bit higher than the actual outstanding balance, but I had no clue as to my rights and what charges could be imposed etc, so by obtaining all dealings with them through SAR i can see exactly what excessive charges have been imposed, it might go some way in paying some towards the balance I owe now..

          The balance the council has seems to be approx 100 more than what i have actually paid rosendales, so I just want to make sure I get back antyhing wrongly charged..

          I had to ring rossendales a little while ago, as my dad insisted, I again wasnt put through to Steve Crooks, but they said my case has been elevated to there complaints department, i shall be told in a letter, and then get a confirmation of what the result will be..

          the guy I spke to, I sahnt put his name on here, said " the way i look at it persoanlly, once they have seen the V5, they can see its not your ar nd should be ok"

          I replied, well are you aware I had that very same proof on the monring and the bailiff refused to look at it !!

          he just said ,oh.. . . Also asked if i have been in touch with the council, so I asked why, becasue you are acting on their behalf and they can end this all now by just tellign you to!!

          I am quite happy I will get the outcome, unfortunately my dad is losing his patience rapidly !! :tinysmile_cry_t:

              ODC, to be honest, I have tried to tell him its all in hand, they have acted unlawfully and once they recieve the letters with the proof, they have no choice but to return the vehicle, so wait until they recieve the letters..

              But hes at home today and he now wants to speak to Rossendales direct, so going to ring them now..

                Record your calls ( and charge them for each one )
                Same with all and any paperwork or letters sent

                There mistake, ( taking your dads bike ), they pay for the time to sort it out.

                Report it stolen, tell the police you have tried to negotiate. when they turn up with the bike, check milage, scratches ect and that everythings working on it still. let your dad claim agaist them. If your not that bothered about getting any money from them, set a no win no fee solisitor onto them for any dammage or inconvienece with them removing you dads bike.

                The baillifs and the council will just waist your time.

                    uuups, would still do the same.

                    They once turned up at a property that i managed and the took the works van, the plumber was not best pleased. The tenant never actualy owed the debt iether.

                      Rossendales have just rang me..

                      They are saying they will not accept the V5 (log book ) as proof my dad owns it, it has been registered to him since he bought it in 2006..

                      They want a reciept and insurance details..

                      Firstly, my dads employer has insured the vehicle for him for the last few years, which expired in November.. so it has his employers name on it.. (a contruction firm, so anyone they give permission to can drive it, they dont have named drivers, it meant my dad could use the Ranger for works purposes, which he has done at times, but also has use of a company van..

                      But I read here somewhere he shouldnt have to supply legal documents like insurance! Please advise..

                      Also, he paid un full for it off somebody, who is on the V5 as previous owner..
                      My dad has no actual recepit, so I have rang this gentleman and he is quite prepared to tell the baillifs he sold it to my dad, when I mentioned my dds name he knew who it was staright away before I mentioned the vehicle..

                      He is happy for the bailiff to ring him direct, or post whatever is necessary.

                      It is getting daft now, after having a V5 my dad speaking personally to Rossendales telling them hes the owner and wants his car back, they are still not accepting it, surely having the previous owner tell them that he did indeed sell the vehicle to my dad will be enough??

                            Tell your Dad to stop faffing about with these shysters. Its his car and they have taken it without his consent. Its stolen and he must report it as such

                                they want the sorn, saying it must have had one because its off the road with no insurance, that legislation doesnt come into affect until April 2011, my dad has been getting quotes of well over £1000 to insure on average, so was holding back as he has a company van too, ( he wished his employer still insured it for him, lol)

                                I think I will be driving down to Corby to meet with the previous owner for the receipt this evening as I am not waiting for postage..

                                My dad will be ringing the police as soon as he gets back from the hospital, she told me on the phone if I dont produce a sorn and proof of ownership, they will sell it, they are startin g once again to be very funny with me, Its incredible !!!

                                A sorn isnt compulsory until April and I am getting the receipt off that guy tonight, then i shall be going into the council first thing in the morning, with the MOT, insurance, log book, receipt for the car, will not leave until I get somebody to take control of this, see that i dont bloody pown the car and ring the bailiffs and tell them to immediately send the vehicle back !!
