I'm afraid I need some advice again please. Yesterday I received the following letter from Philips, undated and unsigned.

      FINAL WARNING NOTICE

As you have failed to clear your outstanding fine, you are hereby given formal notice that the above court may shortly be considering issuing a warrant for your arrest.

Unless the full amount including costs is paid within 7 days we may return this Distress Warrant to the court so they can issue a warrant for your arrest.

If the warrant of arrest is issued a Court Enforcement Officer may attend your premises and arrest you upon sight.

If you are unable to pay the amount outstanding, you are strongly advised to contact our office and make suitable arrangements to clear your arrears.

As the fine is paid in full and there is no longer a Distress Warrant against me I phoned the Court yet again (I have already lodged a complaint against Philips to the Court Manager) and asked for advice, I explained that I'm disputing the amount owed due to the fact I know they didn't visit my premises when they said they did. The guy I spoke to was very helpful and he phoned Philips for me, he said he could log into Philips system and could see that a visit was indeed logged for the 5th January and that notes had been made to describe my front door (the details were correct) I believe the details could have been added after they visited me last week but he said that wasn't possible.

So my problem now is where do I go from here? I know they didn't visit and nothing has been put through my door to indicate they had visited, but if they are saying they have proof it's now my word against theirs. The guy at the Court said as far as they are concerned the matter is closed and if Philips want to they could take me to a Civil Court for the money. I really don't want to pay them this money but if they take me to court it could cost me more in the long run. So any advice would be very welcome.

Apologies for it being so long winded but I just wanted to give as many details as possible.

Any advice would be most welcome.

Phone the court again tomorrow and double check that the information provided was in fact correct and logged on the your; the correct claim number notes.

I would also lodge a complaint re: the unfair treatment that you have received.

Many thanks for the reply, Amy x

I've just downloaded Form 4 and it says you have to put the name of the Bailiff. I don't know the name of the Bailiff or the court that issued his/her certificate. Despite my requesting it 3 times now in writing, they have just completely ignored any requests.

Call the court and tell them that because they refuse to call the bailiffs off despite the fact that there isn't anything outstanding, that you will be filing a Form 4 complaint and that you require the bailiff's name. They must have it.

                    Re: Philips

Just a quick update. I've had a call from an Enforcement Officer at Trading Standards. She's asked me to send copies of all the letters I've had from Philips and requested my permission to speak to - Philips Home Authority Trading Standards and Philips to discuss the complaint? - which of course I've given.

I'm not sure who Philips Home Authority Trading Standards are, does anyone know please? She also said something that made me think, she asked me if by the date of the alleged visit (5th January 2011) the actual fine had been paid by then. I've looked at the breakdown of charges by Philips and if they paid the court first before taking their fee's, the fine would have been paid by November 2010. Not sure what these companies do in this respect though.

I've just logged into my account on Philips website and it's now showing that the account balance is £0.00 and that there are no open cases on my account. Yesterday it was still showing the account balance as £205 due to a Distress Warrant.

Fingers crossed, Amy, I've let Trading Standards know and they said hopefully that will be the end of it, but they are still pursuing it as they feel there are questions to be asked.

I imagine that their home authority TS is Darlington:
