  • Phillips - Distress Warrant

    Hi All

    Hoping someone can shed some light

    i Originally received a fine for no car insurance (bank mix-up) of £500
    i missed 2 payments due to been out of the country on business and then i receive notification from "Phillips" that i have issued a distress warrant for the outstanding balance of £200 plus £ 80 Phillips costs....this letter was issued to a previous address on the 23rd November 2010, i received notification of this around the 27th November to which i contacted them immediately.....unfortunately i was stuck out of the country and couldnt resolve this immediately....over the next 10 days or so i had various conversations with a phillips contact asking for the full amount or else !
    i finally got back into the country monday 6th december and told them i would try and raise the finances over the next 48hrs.....they called yesterday (wednesday 8th) to which i told them that i could raise the money in fuill but not until Friday 17th December.....they told me this wasnt good enough and that if i couldnt get the money today either via a family member or a "pay day" loan !!!!! then they would have no alternative but to send the baliffs round !
    they then called back at 4pm and again i explained i was willing to pay the full amount of £280 on the 17th december......again they said "no good" and action would commence and the £200 baliffs costs had already incurred and would now show on my account.
    About 5 minutes later i received one of their lovely texts asking me to contact an 0845 number to arrange a payment plan......i thought what the hell...so i did this and offered £140 fortnightly commencing friday 17th december......surprise surprise this was accepted !!!
    i am now at a total loss to know what is going on....please can any one offer any insight into this !!!!

    by the way i have contacted the local courts and they have said although this seems "bullying" tactics there is nothing they can do !!

    This part is easy; they are bailiffs, therefore, they lied and they will lie to you again.

      i was fined by the local magistrates court, i missed 2 payments due to what i mentioned earlier, although on the first occasion i did send them a cheque which they said they never received !

        I am in a similar position to you.There is some great advice out there concerning Phillips debt recovery . Unfortunatly...Phillips dont care about the law.They are unproffesional and it is appalling that any HMCS ( Mine being Sheffield) Can use these People to collect debts on there behalf. A disgrace ! Mine was a fine of £120 for a minor motoring offence. Its now £365 !!!! Its a scandal and nobody not even the courts seem able to do anything about it.
        I was told to collect a debt legally Phillips must issue a bond of..i think it is £10,000 with the court that has issued the fine. I checked.And guess what. Phillips have not done this. So someone explain to me how The Magistrate court can continue to use this company !!!! You see the advice is good and correct but, they are operating outside of the law and it would appear with The courts knowledge.I presume the Court must know they haven,t registered the bond.????? I should add at this point that i have at no time refused to pay the fine or even the outrageous ammount of completely unjustyfied costs.But they will not accept that i am struggling financially and refuse to accept what i can afford with a review in a couple of mionths.The telephone staff at Phillips are pig ignorant and not interested in listening to a word you say. They are intimidating and i can imagine they must terrify some people.Let me repeat....The Magistrates Courts are using these companys...So what good is all this advice ???? The Fines enforcer at Sheffield Magistrates Court told me that they had had many complaints about Phillips Debt recovery !!!!! And still they use them ! I think the only way forward is to create an action group.You should write to the courts,Your M.P and anyone else who you think might listen.Anyone interested in doing this with me.please get in touch.The law is all very well but ...it seems its not there to protect ordinary hard working citizens.So..lets try and change things and get a public enquiry into how HMCS can use these companys to collect Debts in this way,and on there behalf. I also have an independent documentary maker interested in this scandal which seems to be going on between the courts and these companys.

          Each certificated bailiff pays the £10,000 bond not Philips as one entity.
