  • Please Help With Walking Possession Issued By Jacobs

    Hi all i am new to the site and would asppreciate any help i can get i was behind with my council tax so it was passed to jacobs they called out and i had just had a baby she was 10 days old i wasnt recieving any money as i was waiting on my tax credits i only get child tax and am currently getting maternity of 125.oo per week so they got me to sign a walking possesion and told me to contact the office in 2 weeks which i did and set up a payment arrangement of 139.00 on the 24th of every month on the 2nd dec i phoned jacobs to ask if they could put a note on their system to say i would be making nov payment on mon 6th however a lady said the agreement will end on sat so i said ok i will have to lend the money .I phoned on fri at 6.40 pm and they were closed answer machine says open sat 9 till 2. I rang sat to make payment they tols me agreement ended fri???? still made payment rang manager this morning very arrogant and rude says he has listened to the conversation and i should have paid it on fri i explained the situation and that having being told the agreement ended on sat i would have thought it meant at the close of there working day he said ive misunderstood then and payment in full is needed!!! it is impossible for me to pay it in full i have 5 children and am on maternity where do i stand can anyone please help it is totally unfair.I am just worried now that i have signed this walking possesion that they will break into my home and take my tv and sofa any info would be much appreciated thanks.

    well your sofa is an exempt item

    can you list all goods levied
    can you tell us the amount of the liability order

      Hi thanks for your reply they have listed a sofa,coffee table which has broken glass top on it and my tv. i owe about 2,000 because they have this years council tax included 10/11 the goods certainly dont add up to that it just seems a complete and utter joke when i am showing willing to pay. seems to me the best thing is to not work you seem to get more benefits and more respect. my health visitor called round today to see how i was after just having a baby i explained the situation to her and she sugested contacting my m.p ??? dont know if this will help??

        it will you no harm to contact your M.P. and your local councillor (If you live in north wales Pm me your council area if the same as mine i know the very man for the job)

        your levy is unlawful bailiffs must levy enough goods too cover all bailiff fees removal fees storage fees auction fees Etc your settee is exempt from levy

        you will defiantly be charged 2 sets of fees (levy walking possession van/attendance fee) because of this levy in your case a nice sum for bailiffs (because of the amount of the debt) and 1st&2nd visit fees

        Send an e-mail to Jacobs copied to your council MP and councillor informing them that you believe the levy unlawful as the goods levied will not cover the bailiffs fees ask them to remove all fees on both account and to send you an amended account
        inform them if they think the levy is lawful to provide an explanation as to why they they think the fees should be charged ask them to provide this information within 7 days as a final response to your (follow up recorded delivery record )

        continue to pay the debt to the council using there on-line payment as this debt should have been returned to council as nullla bona (no goods)

        put the wind up you council by making a Freedom of information request to the council for a copy of there contract/service level agreement with Jacobs

          Did you let them into your property and is the £2000 what you owe in actual council tax or is this the amount Jacobs say you owe?

            Hi thanks wiccaqueen for that help im in stockport cheshire not north wales .I let them in wen my baby was 10 days old thats wen i signed the wpo and they told me to contact there office in 2 weeks wen i was back in reciept of child tax which i did.My issue with them is the fact that according to them my arrangement broke on the friday at 12.01 hrs making it sat!!!!!! so wen i rang on sat and made the payment this is wen they informed me there was no arrangement in place and it is payment in full despite my conversation over the phone when i was told it ends on sat which you would assume you have untill the end of their working day. If i had been informed properly that when they say sat they mean 12.01 hrs i could have made sure i phoned on the fri within their working hours i just see it as pathetic petty and a load of bullies. Amy the amount at the mo is just the council tax there are no added fees YET!!!!!! im not going to get myself worked up about it at the end of the day they cant have what i havent got i am willing to make my monthly payments but hey shoot me down with 5 kids and christmas approaching to pay on the exact day thay want may not always be possible as long as they do recieve the amount each month what is there problem!!!!!

              there will most defiantly be bailiff fees added to your account(s) the bailiff has levied goods you will have been charged a levy fee (s) walking possession fee(s) the fees for this should be on the notice of seizure of goods that the bailiff left you when he levied your goods and more than likely you will have now been charged a van/attendance fee(s)
              Find out from your council

              the date of the liability orders
              the amount of the liability orders
              the date each liability order was passed to Jacobs

              send Jacobs a letter/e-mail and ask for a breakdown of fees to include
              the name of the bailiff that charged the fee
              the date/time the fee was added
              the reason for the fee

                Hi just to keep you updated i have phoned the council they say they cant do anything as the debt is with jacobs so i have rang the ombudsman who have wrote a letter to the council explaining my situation they say it is the council who can tell jacobs to re instate the payment arrangement so hopefullly the council will recieve the letter of complaint and resolve the matter before jacobs take further action of removing any goods from my property. I am also going to ring my local councillor this evening. fingers crossed!!
