  • phillips debt help please

    Hi everyone im new here been reading around the forum all morning lol,

    anyways i had a letter from the courts a week back saying i had an unpaid fine of £60 which was a shock, i had a motoring offence a year before and was paying it out of my benefits,

    my benefits stopped this year in august as i moved in with my partner so that also stopped the payments to the court.
    i phoned them and explained i couldnt afford to pay as im not getting any money and my partner works but we strugle to keep our heads above water.

    They told me that tere was nothing they could do so passed it on to phillips who i recived a letter from today with a new balance of £135 so they have put a £75 fee on top what the hell is that about?

    just phoned them and the guy was the rudest person i have ever spoke to told me i cant pay by installment even tho on the back of the letter it says i can but he just told me were not giving it you i asked about 5 times.

    this was after i told him te same thing as the court and then he says the balifs can come and seize prperty, cars, and everything they want
    is this correct? and also i dont legally own anythng in the house as its not me thats brought the things everything is paid for by my partners bank card
    so do they have the right to take anything.

    and also where do i stand now i have 7 days and no way to pay them?

    Firstly, contact the court and see how much was outstanding on the fine. If it was being paid out of your benefits it wouldn't still be £60. Or is it £60 which is left from the original fine?

    Don't speak to the bailiff on the phone, put everything in writing. Don't let them into your house either. They cannot come and seize goods etc if they have not previously gained peaceful entry.

      yeh it was originally 370 and that was the original left over balance £60 now its 135 lol

      so they dont have a right to enter?
      im sure i read if its court related they have the right to force entry?

          I thought that bailiffs fees for enforcing magistrate court fines were taken from the money paid to the court, not charged to the debtor. I may well be wrong, so wait for Amy - she's the one you need for this!

            I certanly hope so.
            would be able to try and pay the court and tell them to get these to drop it?

              Good luck with Phillips!. Im suprised the company is still allowed to work for HMS and local authorities; this company is based on lies and deception!..You will get absolutely nowhere on the phone trust me!.....

                so how can i beat these guys then?
                the house i live in is private in my partners name not mine so are they legally aloud to break her door down? or gain access?

                  Well your first port of call would be to file a complaint with the Court that employs them; in my case it was Havering. Wait and see what response you get from them, if any!......As for beating them - i havnt as yet and Im taking them to a small calims court to get back my refund, and even that hasnt scared them!...good luck
