    Have I got this correct ?

    A baliff may not make a charge for the use of a debit card? If this is true then Jacobs are guilty of fraud on each transaction as even on line they charge £2 for a debit card payment.

    If as I understand it the council are vicariously liable for that action of the bailiff the are the council also uilty of fraud or a least conspiracy to defraud.

    I was planning to write to both the bailiffsand to my local councillor what do members of the forum feel.

    If the debt is for the collection of council tax debt, then the answer is no, they cannot charge you a card fee.

      Thank you amy what should I dothey charge for each transaction and wont refund the fees . Do I mention illegal charges to them tomorrow or should I just ask barclays for a refund ofthese transaction fees

          nope nowhere near this is still last year's . i' out of work andnot getting benfits as there isan argument over the income from my wife's business.

              i was wondering ifbailiffs are allowedd to make acharge for expenes i.e the cost to them of actually processing thepayment eg15p.

              also if i inform the council that i have been defrauded do they become liable as they are vicariously responsible for the behaviour of the bailiff.Would then the council continuing to condone this be a conspiracy to defraud?

              If I am returned the money bychargeback do I then have to pay it to the council or has it already been paid to the council.

                No, they are not allowed to make a profit from this. They are only permitted to collect the debt and to cover their actual expenses. There is no provision for them to collect a fee for processing a card payment.

                Yes, the council are also liable for this fraud as they know, or at least they should know, that it goes on and they do nothing to stop it.

                You will need to pay the council tax that remains outstanding. However, if the bailiff had already collected the full amount, which is not the case here since you haven't paid it all, then you would be able to reclaim the full amount.
