  • A Quick Bailiff Question

    I got a letter today off Jacobs that was sent out to me via second class post, it was posted on the 15th November.

    In the letter it said that if I don't pay in full within 4 days a bailiff will attend at my property, wtf! the letter took 10 days to get to me.
    I phoned Jacobs to make a full payment and they told me it's too late to pay them as the account has now been handed over the the bailiff, I got the bailiff's number off them and gave him a call.
    It went to his answer phone so Im still waiting for him to get back to me.

    My question is this: if I speak to the bailiff over the phone and offer to pay in full before he calls round, will I still have to pay the extra £110 bailiff fees?

      And more importantly is there a CCJ in place to justify a bailiffs actions?

        It's an old council tax debt that I've been paying off, I missed 1 payment

          In short, no you cannot be charged £110, although I fully expect the bailiff to attempt to do so.

          Precisely what did their office tell you on the telephone?

            I Said I would like to pay in full and they said I can't because the bailiff now has all my details and will be calling round for the full amount plus charges, I told them that I've only just recieved their letter that they sent out 2nd class.
            But they wouldn't budge..

            The bailiff called me back yesterday morning and I explained everything to him, he said because I contacted him before he called round I wouldn't be charged £110.
            He then told me he would call back later when he can take my payment, cut a long story short he never called back and I've made several calls to him.
            He called me back this morning and said he would phone me back between 3 and 5, still waiting
