      Re: mauz

Regarding paying the Council direct, yes this is the thing to do but if I were you I would ring and pay by debit card, and don't just ring the usual council tax payment line, make sire you get put through to the actual council tax recovery office (i.e the ones who deal with the LO and bailiffs). The reason I say this is that by paying online you cannot be sure that the payment will actually be allocated to the arrears, it will more than likely go against the current year's bill which will have absolutely no impact on the arrears and could just make matters worse.

Hi I have been in contact with council regarding my unpaid council tax with a proposal to pay I have also paid on line as advised. I also contacted the Head of my councils finance department who is looking into my case. I want the council to take back the debt.
My son has just rang me to say the bailiff has just been (he did not let him in) the bailiff has told him that if I do not pay that he will be back tomorrow with the police is this a threat or can he do this? please jelp this is begining to make me feel sick with worry

The bailiff has no right under normal Council Tax Arrears to enter your property - do not let them. We keep telling you they will threaten all sorts. They are liars. They might come back with the police, BUT if they do the police are not there for anything other than to uphold law and order (stop a fight!). The police have no interest and will not get involved with council tax debts. Let the bailiffs come, let them bring the police, DO NOT LET THEM IN. If necessary explain to the police from an upstairs window WHY you're not letting them in and that they can check if they want that you're trying to sort things out direct with the council.

I know how stressful it is - I've been in your position - I only wish I'd had access to this site's brilliant advice when I was in it! Try to calm down. pm coming your way!

                  Re: mauz

Firstly, have you actually agreed a payment proposal with the Council? If you have, then put it in writing to the Bailiff company and ask your Council to confirm this with them.

Secondly, the bailiff cannot gain entry to your house unless he has previously gained peaceful entry., which presumably he has not. He has no valid Walking Possession or levy so he is talking in usual bailiff speak - lies and threats. His threat of bringing the police is more than likely an empty one. He has no legal right to enter your home unless there are valid walking possessions/levy in place.

Have you read the Bailiff guide at the top of the Forum? Bailiff Guide - Legal Beagles Consumer Forum

Thank you I am not aware of a walk in levy so will check this out, I have been onto the council and informed them that I will be making a further complaint direct to them as the bailiff told my son that he would be back tomorrow with the police surely thay can not have that type of conversation with a 15yr old as he is still a child?

                      Re: mauz

Read the Bailiff Guide in the link I gave above, it will make things clearer.

You would know if there were any walking possession or levies in place - you would have had to have let the bailiff in to your property in order for him to have raised them, what's more you would have signed them for them to be valid, I believe.
