  • Marston group and tv fine.

    Hi folks,

    On 26th of this month i woke to fid a notice pushed through my letterbox from Marstons that unless i contact their enforcement officer immediatly my goods etc can be removed for payment. On 28th (today) i awoke to find a Final Notice pushed through again.

    Fine amount £875 with admin fees of 75 and attendance costs of 200 on top of fine.

    My circumstances are, im housebound with A1AD copd(emphysema) which leaves me practically housebound. I am on state benefits at this time, have no goods of any value whatsoever and am a single parent of 2. Any advice would be greatly appreciated on this matter.

    Should i contact the local courts to set up a hearing for time to pay the original fine as i would rather be paying them as i have read Marstons do not really accept any kind of installment plan. I have also not seen a copy of the warrant.

    I should point out that the pieces of paper shoved through my door are my first and only contact/communications recieved from Marstons.

    Do you have a TV licence now?

    The fine for not having a TV Licence is issued by the Magistrates Court. You must treat a Magistrates Court fine as a priority debt because you could be sent to prison if you default on payments and, although very rare, this does happen.

    If, as in your case, a warrant has been issued, you are required to either pay this and if you are unable to do so, you must contact the Fines Department of the Magistrates Court to arrange a date when you can attend for a Means Enquiry Hearing. This should be done immediately. At this hearing, you will be required to complete an Income & Expenditure form in order that the Magistrates can agree repayments at an affordable level.

    I have to say though, the fees do appear to be about right for a fine of this nature.

      Thank you for your reply Amy, will contact the court, and yes i do have a TV licence now.

      One more thing should i phone the enforcement officer telling him i have contacted the court to get a hearing and will this stop him returing to my address?

        Yes, I think you should and follow it up with a letter, but do not let him intimidate you into anything. Report what he says to the clerk at the court when you speak with them.

        Make it clear to him that you are not unwilling to pay, just unable to pay what he is asking.
