        This seems an awful lot to me, I think you should get the SAR off as soon as possible.

        Bailiffs are certificated, they are not certified.

          sorry i dont understand about the certified part?i checked out the actual baliff man ? he came up as certified...i messaged the council, the court that issued him the bailiff pass,the actual company newlyns..when i ring newylns they just say oh its all to do with the baliff just call him?? If i wrie an SAR, wont i just get bk the rubbish that he wrote on the piece of paper i recieved today?and i need my car bk...

            Certified is having a document that proves that you have successfully finished a course of training and have gained a certificate. Therefore, becoming qualified.

            Certificated is what a bailiff must be in possession of when collecting certain debts (see the bailiff guide for further information) and the difference is that he is then authorised by way of a certificate. It does not mean he has completed any courses in order to become qualified, but merely paid his bond.

            You do not have to write an SAR, we have written one for you and you will get back all of the data that Newlyn hold on you and this will include the dates they allegedly visited you and how their fees are broken down.

                You send the SAR to Newlyn and wait and see what they come back with, then you compare that information with what you have or what you know already.

                  ok thats up to 40 days reply isnt it....so i pay and get my car backi n the mean time?i need back my car, can i pay islington council seperate and get the clamp removed ?

                    I have had issues with Newlyn for nearly 2 years, the debt has gone up from £155.00 to over £600.00 I had an agreement with them to pay £40 a month. I paid on Friday and then called them to say I had made the payment so it was logged and they informed me that the debt was no longer with them and had been passed back to Croydon Council, when I called them they advised that the file had been closed and that I did not owe any more money, no letter to say so. I am now going to have to fight Newlyn to get back the £40 I paid them, will keep you updated.

                        LLLOOOOLLLLLL! well michelle I hope its all as it seems! I'd get ym letter from the council and just be glad i saved £560!wow! made me smile! any more advice for me amy? about gettin my car back?i think I'll pay them and then file for the form 4! i know it wont be over night but I'll fight it till the end!:beagle:

                          I really think you need to make a formal request for your information. You can find one here, just edit to suit Bailiff - SAR - Legal Beagles Consumer Forum and do not forget to enclose the statutory maximum fee of £10.
                          Sorry, only just catching up in middle of holidays, so only on for a couple of hours. I agree with Amy above BUT make sure that you specify the £10.00 is for the SAR and NOT to be set against your "debt."

                          I'll try and look into the bit about Islington Council for you, though bear with me - my signal keeps going and I'm not home until Sunday - sorry!
