Hello,
im new to here so please bare with me if i go on abit but i really need some help.
i have received a letter from newlyn bailiffs today stating that i owe then 310.89 and that they are operating in my area and will be clamping my car ( my car is a motability car for my daughter.)

i called them up and asked how they got there fees as the parking fine was just for 125 pounds they said that is the amount that needs paying and thats it i told them that i would pay what i had to pay the 125pounds and i will seek legal advise for there fees but they said i had to pay it all or they would be coming.
i will only pay what is owed for the parking fine,what do i do i havent as yet paid a penny as i think there fees are wrong this is the 1st letter i have had.

Hi and welcome!

You've come to the right place.

We could do with a bit more detail. The debt is obviously for a parking fine. Where were you parked (public or private land?) and who was the original debt owed to?. How long ago was this? Have DCA's been involved and if so which ones and what happened with them?

The more you can tell us the more we can help. My understanding is they are not allowed to take a disabled car. Don't worry, let us know as much as possible and everyone will try to help.

The fees do seem very steep, have you asked for a breakdown of their fees? Were you aware of this parking fine?

They are not allowed to clamp a motability vehicle, but you will have to provide them with some proof.

If you have not had previous notices of this parking fine yoy can apply to file a Statutory Out of Time declaration to Northamton court. Details are on the court website along with the form you need to fill in. This is free, and will immediately stopall action. You will also need to send an SAR to the bailiffs (you can find a sample one on this forum) which should give you a fee breakdown. Oce you have that post the details here and people will try to help you from there.

First things first... as long as you prove to them it is a motability car they cannot legally clamp it.

Secondly, you need to understand that bailiffs earn their living through making threats in the hope it will scare people into paying. As your car is safe as long as you prove it's motability, then we move onto your other possessions which I guess are in your house. THIS IS IMPORTANT. You do not have to allow bailiffs to enter your house, so don't. Keep downstairs doors and windows locked and speak to them from upstairs saying you will only deal with the original creditor (would be good to know who it was as there is a big difference between a parking ticket on council land (Fixed Penalty Notice) and a parking ticket on private land (often made to look like a FPN). Do not under any circumstances let the bailiffs even get a toe inside your door as they then have the right to break in pretty much when they want. They will try asking to use your phone to phone their office, discuss it in the warmth, need the toilet... anything to get in - don't let them. They will continue to threaten and say they are going to do things and keep sending you updated versions of ridiculous fees, but if you pay the fine to the people you actually owe it to there is nothing they can do about it.

Try not to worry, don't let them in, remember they earn their living by lying, so when they say they're going to turn up, it by no means means they will. Let us know who you owe the money to and all should be well.

Hi,
All a bailiff has to do to ascertain that it is a motorbility car is to look at the Tax disc as it is clearly marked on that by the issuing Post Office, so yet again total disregard on behalf of the bailiffs.
