hi im new to this site so any help would be great i have a bailiff removal notice for council tax it doesnt tell me how much i owe , ive tried to talk to the council but theyre not interested and tell me i have to talk to rossendales, i offered to pay the ammount to the council and they wont take payment and again said to talk to the bailiff in charge,the council say i owe 1075. and rossendales say i owe 1360 how do they work this out can you help. i have never seen them in person they just posted a letter through the door, this is for last years council tax

Hi there,
They can definately recall the debt. The bailiff works for the council, and they can be called off at anytime. To get this done you will probably need to contact someone in authority at the council such as head of Council Tax rather than just the council tax call centre who are usually hopeless and disinterested.
I would pay as much as you can to the council (you should be able to do this online and if not send a cheque and covering letter by registered post). Also make sure you don't have any contact with the bailiff - and keep all your windows are doors shut. If you have a car you will need to park it somewhere else for a bit until this is sorted out. Once rRossendales realise you are not going to let them into your house or pay them and you will only deal will the council they will go away. A warning though - this could take a while as they are very tenacious and will do anything to make you pay.

I'm not an expert, but from my little knowledge I'd agree totally with the above. The council CAN recall the debt, though they don't like doing (been there and done that, so it can be done!) I can't see the council returning payments to you if you send them money by registered post. The bailiffs will make you pay it over and over again if you deal with them, they are usually lying, evil, nasty bar stewards!

Just make sure that if you pay the council direct you make sure and tell them it has to be taken off the debt that is with the bailiffs, otherwise they may credit if to your current year's instead of the other one, if you see what I mean.
The council can recall the debt but you have to realise that most council staff don't know much about anything. You need to write to them telling them that you will be paying them direct at xxx per week/month, enclosing the first payment. Also point out the actions of the bailifffs and where the bailiffs have gone wrong, so to speak. Remind the council that they are vicariously liable for the actions of the bailiffs whom they employ.
You said Rossendales have a Removal Notice - is this valid? Have you ever let the bailiff into your house, signed any Walking Possessions or levy? Have they given you any breakdown of how the alleged 1360 is made up (Made up being the operative words!) and what charges have been applied?
You can get this returned to the council but it may take a while and you will have to be prepared to stick at it.
Also, once it is returned to the council and you have agreed an instalment plan you MUST stick to it, otherwise it will just get sent back to the bailiffs again, so make sure you only agree a figure which you can afford.Is no longer here
