  • Jbw Bailiff

Morning guys, im very very new to this forum, so apoligises if im repeating myself on a topic thats been spoken about before.

I have a car hire firm based in london and have had a lot of parking tickets issued and liabilty transferred successfuly.

Unfortunatly, there were two tickets that have slipped through the net.
Back in april of this year I was advised that JBW were dealing with these 2 parking tickets, and that they demanded an amount in excess of £1000.

I spoke to JBW and explained that I wanted a list of charges as i do not beleive that this was the case.

This was never sent to me

I decided to contact them again in June 2010, and this time asked them to send me a list of charges and also after speaking to the bailiff advice line was advised to obtain JBW's bank details and forward them an amount of £185 + court fees of £10.16 to satisfy the warrant they had issued.

With this in mind, I was hoping for JBW to agree that the fine had been paid and that the warrant was satisfied, therefore making them unable to chase me for their fees...? Was this correct?

Anyway, after speaking to a DARREN JESSOP of JBW who has been very very forceful and on numberous of occassions has threatened me with "you watch what will happen to you" I still have no resolotion to this matter.

I still do not have a list of charges and very very unsure as to what to do.

I would appreciate if someone could assist me as i am desperate for some advice.

    many thanks

    Beppe

If you made a formal request for your charges including the statutory maximum fee of £10, then they cannot simply refuse or ignore you.

If you did not make a formal request, then send this one, amended to suit and enclose your fee Bailiff - SAR - Legal Beagles Consumer Forum

As Amy said make the formal request enclosing the £10. Didn't look at her template letter, but make sure it says the £10 is for supplying the requested information and MUST NOT be put towards the debt. If these people are threatening you on the phone, I'd also ensure you record every phone conversation you have with them with time and date of it just to start building a true picture of these people should you ever need it.

Finally where were the FPN for -ie- where were the vehicles actually parked at the time? Was it council or private land?

Send off the request - I think I'm right in saying they have 14 days to respond to this (12 + 2 permitted for time spent in post), others will correct me if I'm wrong as I'm quite new to this too.

for S.A.R requests they have 40 days to comply wtih the supply of data/information. The 12+2 is for CCA requests which is not the case here.

Thanks Wendy - I'll get there eventually. I'm pretty sure that the limit then is 40 days and not 40 working days. Again someone will tell you if I'm wrong!

Yes I think it is 40 days. If they don't comply then they should be reported to the ICO. Getting info out of them will probably be like pulling teeth but if they don't comply at all etc this can be a very useful tool and used in defence in any court action they may take, or indeed any court action Beppelondon may decide to take against them. Personally if it was me I would just ignore JBW completely. Don't speak to them by telephone, don't phone them, don't take their calls. Write to them informing that this matter will only be dealt with in writing etc etc. If they want any more money out of you let them pursue it by the correct channels and using the correct laws (not that they would know what the correct laws and channels were even if they jumped up and bit them on the arse!)

It is for them to demonstrate that you owe the debt and why.

Jessop used to be the director of recovery at tj meagher a debt collection company which waller bought out in 2008. Hence you may well find he has a habit of threatning people. Also have you filed out of time witness statements on these tickets yet ? I attach the form. you do not need to pay a fee for these

Make sure you keep all evidence - texts, record all phone calls etc... They may come in useful, especially if you're being threatened.

Do a subject access request with them and watch them squeal as if they dont comply complain and also do a no compliance claim against them. Until you have the tickets cancelled you cant do a lot about jbw. You could on the other hand pay them wait for the out of times to progress and then hit both the instructiing authority and jbw with a claim for restitution. since my time with them i have heard that they have become good boys.

Was the vehicle(s) parked on private or council car park or was it parked in a public restricted zone???

Okay guys an update on JBW. After writing and requesting an SAR of my account and enclosing a cheque of £10, they have not written to me and have indeed put the cheque towards the balance owing..

                          What do I do?

Complain and do a non compliance claim against them. Point out in your complaint you specifically asked for the money to go to the SAR not to the "debt."

Apologies if I now vanish. Putting it in all posts tonight as in middle of holidays and won't have internet access again until Sunday!
