  • Can I Do This Now?

    About 3 years ago we had a nightmare with Council Tax and it ended up with Andrew James Enforcement in Swansea. They were horrible. After a long, long fight with lots of lies on their part we managed to pay off the debt.

    My question is, after all this time, can I contact them for a breakdown of fees to see if their actions were legal and see if I can get something back from them?

    If anyone can give me a starter on this (I don't have the paperwork anymore, but they must and the council must) I'd be really grateful. It would be nice to get some revenge!

    Start by send a DSAR to the council and the bailiff company.

    This should get you the data you need to progress.

    Edit this to suit:

    Dear Sir/Madam

    SAR (Subject Access Request)
    FULL NAME : FULL ADDRESS : POSTCODE
    Any past names/addresses

    Account numbers (if you know them)

    1. I formally request that you forward me a true record of any Data held by your organisation relating to myself for any and all accounts held currently or in the past with your company. This should include, but not be limited to all transaction lists, agreements
    2. This request should include any Data held for more than 6 years as under the Data Protection Act there is no time limit for information requested.
    3. If you do not hold Data for a period longer than 6 years I also request confirmation of this in writing along with your methods used for disposal of such information to comply with the Data Protection Act stating the name and contact information of your registered Data Controller and Code Compliance Officer.

    I enclose the statutory maximum fee of £10. You have 40 days from receipt of this request in which to return to me the information requested , securely and in legible condition.

    Please note that the above address is the one registered with your organisation and which you have previously found to be acceptable.

        Nothing you can do until you get the information requested, remember this info can take upto 40 days to arrive nothing you can do about that as it is statutory.

        Remember to enclose the £10 fee in each letter this is statutory too as per the DPA 1998

                Thats it soon as you get all the data they both hold you can then research it and plan the attack.

                    Letters gone recorded delivery this morning to Andrew James and the Council. Pretty mcuh the SAR on the sticky, modified as I didn't actually get any visits, just threats and lies, more lies and even more lies.

                    Will post again when I get replies from both parties.
