  • Marston Bailiffs Warrant-Please Help

    This is my fisrt post.
    I was visited by a very big bully from Marston's yesterday. He entered my work premesis stating he was an enforcement office to a member of staff.
    The Story.
    My company relocated in March 2009. No notices for payment was sent to our new adddress. The old premesis did undergo major building for the whole of 2009 and 2010. It was only until a week ago that the new owners of my old premesis has sent me these notice. The notice stated that I owed them £262.71 from a PCN and was dated 3rd August 2010.
    However the bailiff visited yesterday at my new address stating that he has a Warrant of Execution, which he refused to show until I paid their fees. He did however show me his notes of a warrant that issued for the old address. I told him that we did not receive any correspondence at this address. He told me that a notice was sent out to the new address on the 10th of August 2010.
    This guy was very aggressive and even told me to step outside if want to have it on with him.
    I called the police and they told me to call my solicitor because it was a civil matter. My solicitor told me to pay and get rid of him.
    He then demanded £469.33 which I paid and he handed me the Warrant of Execution which was dated the 23 September 2010 and had the companies old address.

    My questions are.
    1 The warrant has my old address on it does that give them the right to execute it at my new address.
    2 The warrant has a Marstons Group logo at the top and there is no seal from the court, is this legal for them to print of their own warrants?

    Any help and advise would be appreciated

    Upate!!
    I spoke to Northamtop County Court this morning. They advised me that the bailiff acted unlawfully. Because the warrant was invalid for this address and that the council should have applied to have the warrant re issued to the new address.
    Been on to Marston's explained it to them.
    Just faxed over a letter demanding a full refund of the payment. Will wait to see there next move.

      Your problem here is that you have already paid and getting your money back is going to be a hard slog.

      However, it is possible, but you will more than likely have to sue them for it. If you are certain you want to take this course of action then you should begin with sending a Subject Access Request to Marston. You can find a link to it in the Bailiff Guide - Legal Beagles Consumer Forum

        I am sending off a SAR. I am looking into sueing them and have the bailiffs licence removed.
        Because the bailiff told me infront of witnesses the he will take off his badge and have it on with me. He swearing at me and calling me F*ing this and that.

            marstons are the lowest of the bailiffs used to be known as drakes at one point if memory serves me correct a few years ago they were the subject of a whistleblower programme where someoneposed as a bailiff to expose thier underhanded tactics if I find a copy somewhere ill post the link for you.

              This company has been to my address today get to the point I had to pay £814 for my ex partner. This was for his court fines. Apparently as this was his last known address he is associated with here therefore the warrant has been issued to my address. Although everything belongs to me these guys stated that they have every right to assume that all items in the property belong to the debtor until proven otherwise. I did have a council tax bill there which proves this is my address however my tenancy agreement was not with me to prove further that he does not reside at this address. These guys informed me that unless I gave them access to my property they will return to my property with a locksmith to remove goods to the sum of £814. How can this be right, these are my things and this is my house not my ex partners surely they should have done a track and trace on him and realized he is registered at his dads. This is unfaid. Would the warrent they came with be invalid. In addition to this can I claim this money back from these thugs?

                I have had a distress warrant issued by post i have not let anyone into my flat but the letter says they will force entry.
                i spoke to the bailiff on the phone to come to some arrangement but she?(disgrace to all women) said no way shes giving me till friday ?tomorow 03/02/2011 i will be at work and i cannot raise the money can they force entry. kazz

                    do marstons have the power to enter my property and take my things they wont agree to terms with me and say they will force entry tomorrow and i will have costs on top of what i owe.
