I have just had a conversation with a bailiff concerning an unpaid parking fine going back to August last year. Unfortunately I believed I had paid it but it seems there were more than one! I moved home in December and made every effort to ensure all necessary parties were aware of the move obviously including the local council and importantly the DVLA. I arrived home from work on Friday to find a Notice Prior to Removal of Goods had been put through the door, demanding a sum of £333.41 with this increasing to £554.82 on a second visit. Following many attempts I was able to speak to the named bailiff today explaining that I had been unaware of this particular fine, I had received absolutely no correspondence from the Enforcement company warning me of this and that I felt I had been treated unfairly. He stated that the company were not obligated to advise me of an impending visit and that furthermore all correspondence would go to the previous address because that was the one they held. He further claimed that several? visits had been made to my former address and that in fact I owed a much larger sum which he had magnanimously reduced given that I was unaware. Odd really, surely one visit would have revealed that I was no longer resident, and, given that they have traced me to this address now what was the difficulty in tracing me previously - I have been registered to my current address since the move. He also said that he could not make an arrangement to pay over a couple of months, and that he would give me 4 days to make the payment. Should I pay and then pursue for recompense or submit an SAR-would this stay matters for the time being?

Hi there,
I think that if you did not receive a parking ticket or were not aware of one you should be able to sign a Statutory out of time declaration with Northampton Court explaining that this is the reason you did not pay the council. Once this has been accepted (which should be the same day you email it to them) the council have to inform the bailiffs to put the case on hold as you are disputing it. Even if they then reject your Out of time declaration it will take a few weeks and you can get some response to the SAR in this time.
