  • Rossendales!!!

    Hi,
    About a month ago a bailiff from Rossendales came to my door about unpaid council tax charges, i didn't let him in my house at all & advised him that i had previously paid my outstanding balance with them & didn't know what this money realted to. He said he would go away & investigate this & get back in touch.
    Now he has left me a hand delivered Magistrates Liability Order/Distress Warrant. I phoned him about this when i got home from work and found this & requested the amount i owed (which i'm sure has got to much in charges added onto it) and what happened with him looking into where this money was owed from. He said that he had never said he would look into this but that i should!!
    He is now telling me that if i don't pay the full £498 by 2pm tomorrow (24/09) he will remove my goods including my car which is parked next to my house! I know he can't break into my house because i haven't granted him peaceful entry but can he take my car? This is worth approx £4000 so nearly 10 times the amount he says i owe!
    What should i do? I offered to set up a payment agreement with him to buy time but he refused my offer & says i have to ring him before midday tomorrow with positive news!!
    Please help, i need my car to get to work everyday & i can't afford to pay in full.

    Firstly Do not panic and do not believe a word that comes out of his mouth .

    You need to move your car away from the house and get it somewhere safe this will prevent him from placing a levy on it .Never let him in your house and he is powerless to do anything .

    Some one will be along with more experience that can advice you of your next course of action

        You should not be taking the word of a bailiff that you owe anything. Check with your council to see what, if anything, you owe and then make payments direct to them.

          Ok guys, I have managed to get the original amount that i owed & its only £306, meaning he's added on £192 in charges. I'm still waiting for a response from the council as i haven't been able to speak to anybody on the phone so i e-mailed them, they have read the e-mail but so far no response.
          The bailiff is now leaving me voicemails saying i haven't phoned him, when i have & that he's trying to resolve this in an amicable way but i'm ignoring him so unless i contact him immeadiately he's going to come out & remove my goods including my car!
          I've moved my car away from the side of my house but could he really take a car worth £4000 for a debt of what he claims to be just £498?

            Hi all,

            I need advise regarding the above, i've got a break down of the charges the bailiff has added onto the account - they are the 1st & 2nd visit charges, then a 'Van visit' charge of £110, a levy fee of £33 on my car & a waiting charge of £60 for an appointment the bailiff claims i made with him that i didn't.
            Firstly so far the bailiffs & Rossendales are refusing to confirm how i made this so called 'appointment' & i don't know how to prove i didn't make it without them telling me this!
            Secondly the bailiff placed a levy on my car on 18/08/10 however the change of ownership into my name for this car wasn't processed until 25/08/10 so even though i have owned the car since 16/08/10 when he place the levy on it the DVLA were not aware of this so does this make him levy valid?
            And thirdly i've asked the council to take the debt back so i can pay it directly to them as i'm already paying them another amount but they have refused, how can i get them to do this?
            Please help urgently the hold that is on my account runs out tommorrow so the phonecalls & visits will begin again

              I would send an SAR request to Rossendales immediately. This won't put anything on hold but it will get to the bottom of the charges, which are clearly ficticious. I'm certain they can't charge "waiting time". If the car was levied when you did not own it I think the levy would be invalid. The value of the car v the value of what you owe seems to make no difference to them. They just want to take as much of your money as possible.

              Keep the car somewhere else, do not respond to their calls, texts or letters and do not let them in to your house. Meanwhile send the SAR and write to your council.
