I wish i had read all this last year befor i let the jacobs in to my home! non the less i did let them in and they gave me all the documented speel and i made a payment agreement with them after them listing everything in my house! the original debt was £830 which i have been paying off at a forced agreement from council with jacobs at £43 a month. unfortunatly i missed my aug payment and they now want £298.63 in the next four days which i dont have. the unfortunate thing is that had i made the aug payment this debt could have been included in an IVA i am just setting up as it is last years council tax. i have managed to beg steal and borrow £250 to pay the bailiff and they have refused this amount saying they are still going to sent it out to the mobile bailiff to seize goods!! there is no way i can find the rest of this money and dont know what to do. any advice would be appreciated. all for the sake of under £50!!

Jacobs have lied to you, which is why you still 'owe' them money and the council is complicit.
However, what to do about it is completely up to you.
If you want to try and get your money back, we can help you. We can help you with this latest development, but we will need to know what goods were listed on the walking possession as it might not be valid.

hi. what is listed on the walking possession is absolutly everthing that they could see at the time even though i told him a few things didnt belong to me and the things that were on HP. most of the stuff moved out when my sons did. i.e the playstation and wii, they even listed my cooker washing machine tumble dryer and sofas. i didnt think they could list things needed for daily living but i know next to nothing about these things. i did have a copy of the document that i signed under duress as i knew most of the stuff wasnt mine. the baliff just said not to worry about that as all i needed was proff if it ever came to them taking anything. i actually called them today with the offer of £250 i know its their job but i really think they are in the wrong one!! absolutly no customer service skills and absolutly not interested in my personal cercumstances at all.

hi again all. just been reading some posts regarding various bailiffs and wow there are some nasty people about do you think they really enjoy their job?? reading all the posts really does make me feel stupid for ever having let them in in the first place and the more i read the more it seems i dont have a leg to stand on now!!

hey i've just been reading that bailiffs cant charge when i pay by debit card.. i've been charged £2 every month!! do they cover themselves by saying there is a charge for making this payment??

You could have this debt paid by the bailiffs should you choose to.

Amy you make it sound so simple! where do i go from here? it doesn't seem i can stop them comming into my house. and to dispute all this will take longer than they have given me to produce the full amount. ill read the things on fraud now. im sure you've been told this befor but your a godsend!!

Bailiffs lie, it's what they do and I am certain that once he knows that you know your rights and that that walking possession is invalid plus you are accusing them of defrauding you - they will back off.
I know it's easier said than done, but try and get some rest. Even though you have allowed them access, it is very, very rare for a bailiff to break in to a property, so post up all the background information tomorrow and we'll take it from there.

Hi Amy. some back ground from me, apart from the fact i did everything you say not to on this site!! i wish i'd found it back in jan!!! i had my first seize of goods notice posted through my door in jan, i had been paying my council tax to the council and still was but i missed 1 payment, i called the bailiff on the letter who said i had to now pay him and not the council, which stupidly i did! i made arangments for them to come and collect the first payment of £150 on the 28th feb and they didnt turn up. i called and they said the bailiff who was comming out no longer worked for them and they would pass the case to some1 else. an arangment was made for some1 to come out on the 5th march which they did. after LETTING him, i had my eldest son with me, he proceeded to list everything he could see in my home, i told him most of the things he was listing were not mine ie TV Playstation wii laptop (my eldest son was moving home) and i told him the things that were on HP washing machine tumble dryer and cooker. he informed me not to worry about that as i just needed documentation if and when they came to collect said goods. having done his worst on the list he proceeded to take payment and wanted me to sign the iist of goods which i refused saying i cant sign something when i know almost all on the list didnt belong to me. the bailiff then informed me that if i didnt sign then he would be unable to make a payment arangment and they would be back with a van to collect all the listed goods!! i went into panic mode thinking they were going to empty my house and signed the form handing over £150 and making arangments to pay £115 the least he said he could accept per month, i did this knowing i could not afford that amount along with this years £110 council tax. he took the money i had borrowed along with his letter and off he went. i then went to the council and they put me in touch with their own money people (debt managers) who did a financial statment for me and contacted the bailiff to inform them the most i could possably pay was £43 a month which they accepted. i was told that if i pay by debit card there will be a £2 charge on top of this, which i found amazing as the finantial statment said the most i could afford was £43. but non the less i paid it monthly up untill aug 28th when i missed the payment. i now have a letter saying i have failed to keep to the agreement so it has been cancelled and WILL NOT be re-instated. full payment is now due or a bailiff will attent my property for the purpouse of removing goods for public sale which will incur additional costs! the amount they want is £289.63. i dont have it.

i have begged and borrowed from friends and family who i really didnt want to know about my finances and managed to raise £250. i called jacobs and told the abrupt smug arrogant man on the phone that this was the most money i could raise. all this man said to me was if thats all then the bailiff will see you to collect goods. i said but that is all i can raise and leaves no electric for the rest of the month he just said the bailiff will call to collect all goods. he wasnt interested in anything other than the full amount and adding jacobs costs to it!
thats it in a nutshell. i dont have a bailiff to contact who is suposed to come out and i dont have anyway of raising the other £50 plus costs!
feel pretty much like ive shot myself in the foot by doing more or less everything they have asked.
sorry this is so long winded!!
most of the things on jacobs list are no longer here as they were my sons who has now moved out! the washing machine and tumble are still being payed for and belong to brighthouse for another 18 months. possable the only things on the list that are mine are the cooker and my leather sofas.
am i totally stuffed here!!

Stop panicking. All is not lost.
The levy is illegal and invalid; he lied to you to make you sign it; he's levied on goods that either did not belong to you or were on finance; you have been charged a non-prescribed fee and this is just for starters.
We need to start writing some letters of complaint to your council. How are you at writing letters?

not great Amy usually ends up a 10 page letter for a 1 paragraph statment with the person still not knowing what im talking about!! but hey i'll give it a go to stop the headaches!! do i write/e-mail the council and the bailiff? how much information do they need and what about legal terms?Last edited by dispondent; 11th September 2010, 09:16:AM.

hi again. im sat trying to work out what to put in a letter of complaint to council about bailiff and also what do i do when this bailiff does turn up to "remove" goods? sorry for being a pain but im not 1 to complain as a rule as you can prob tell from being in this situation in the first place i usually comply to threatening demands! what a muppet!

i don't have a name of who is meant to be comming out as yet. just a standard letter telling me what i need to pay to stop a bailiff doing so. i didnt get the name of the office bound idiot who refused my offer. im sure jacobs just want to make it as imposible as they can so they can charge more fees!
