      Just to update. Letter was sent to Rossendales over 3 weeks ago and we've heard nothing since. No payments have been made to them either. Fingers crossed that's the end of it.

        Unfortunately, another letter has been posted through our door for the same debt, and using the same threatening language.

        Do we just ignore or try to take steps to stop Rossendale's from harrassing us?

          EMERGENCY UPDATE:

          They have clamped my car under threat of removal to public auction. No answer when I called. Seriously panicking now - what can I do?

                What do you mean it has made no difference? They are not allowed to clamp or remove goods that do not belong to the debtor - it is illegal.

                Have you provided any proof as to who owns the car? If not you should do this immediately and demand its return.

                  He said there has been a charge put on my car and my wife's car for the debt and that he is under no obligation to remove the clamp.

                      Yes. And as far as I am aware there is no outstanding debt to Leeds city council.

                        However, this is not your debt and if you want this car back then you are going to have to get tough with them, very tough.

                          Spoke to someone from the Leeds city council today. He told me that the council authorises the bailiffs to charge a payment of £110 for 'attendance to remove' and that this can be charged whether they speak to someone or not. Feel that I don't have a leg to stand on.

                            the bailiff can only charge an attendance to remove fee if they have a valid levy on the debtors goods

                              have you ever received a notice of seizure of goods and inventory listing the cars as levied

                              is the car still clamped

                                The advice you have been given here is correct and explains fully what Bailiffs can and can not charge. It is a shame you feel as though you can't take this further, as you would have had the help you needed to sort out this matter.
