  • Distress Warrant

    I have just received a distress warrant hand delivered to my home. The warrant is for unpaid council tax from a previous address. The warrant itself is is basically a piece of A4 with 'Rossendales' on the top. It states only that it is a Magistrates Liability Order / Distress Warrant for unpaid council tax. It does not state for how much, or indeed for which address. I contacted the bailiff directly on the number listed. He informed me that the amount was £795 from an old address. I offered to pay this in 2 instalments, namely, half on 9th July and the further half on 23rd July. This offer was immediately rejected. I find this very strange, as the distrees warrant was the first contact that had been made at this address. I have had no previous contact and no 'walking possession order' is in place. Yet the bailiff maintains that he has the right to enter my property on his reuturn. Is this right?

    You need to read this Bailiff Guide - Legal Beagles Consumer Forum and never contact the bailiff again. Ever.

    First you need to ascertain whether you owe this money, which I am presuming you do since you have offered to pay, followed by precisely how much you owe. You need to request this information from the council. When you have this information, pay the council direct.
