Are bailiffs fees quashed when fine is quashed?

  • Are bailiffs fees quashed when fine is quashed?

    I am being chased by Marston for non-payment of a HMRC fine for not submitting annual accounts. This fine has now been quashed as the company has been closed down.

    Can the bailiffs keep sending letters to collect their own fees once the HMRC fine has been quashed, or does their right to chase for their fees end when the original fine is quashed?

    If the company has closed down is it:

    in liquidation?
    a limited company?
    Self Employment?

      Technically, they are allowed to charge for work they have actually carried out. However, I would presume here that they are charging for far more than they have actually done and it is highly likely that they have not done much at all.

      How much and what are they trying to charge you?

        I was a limited company which was closed down. I used to be an IT contractor.

        They are looking for £565 which presumably includes the £200 fine which has been quashed. I am checking the exact status of the fine with the magistrates courts this morning, but my accountant assured me it was quashed back in March.

          Ok you say that the Limited company is closed down, did you just not trade anymore and what date did you cease trading with this Ltd Company?

          Did you check with your Accountantant if you have any correspondence with the HMRC to substantiate that this debt is nul and void?

          If you do have such documentation from your accountant, was that issued before the bailiffs started knocking?

          I think you need to ascertain this and also you then send to Martsons a Subject Access Request, for all the documentation that they hold on you and a breakdown of their fees and exactly what they claiming for on behalf if HMRC and the date which HMRC gave them the job to hound you?
