    lol,im not being defeatist,i dont want to pay them anything.but im gona end up paying them something,it just peed me off cause if id noticed the cheque from the original fine hadnt gone out i wouldnt be in this mess.im not gona give them anything till ive had my paper work back!thanks.x

          hi again,ive received a letter today from equita stating that if i want my sar then i have to forward the sum of 10 pound to them under the data protection act.once they receive the money they will forward my information,lmao.im bloody fuming they already took the sum from my bank on the 7th of this mth.i rang them and was told id have to put it in writnin r email them,.wot is this company playin at,just another excuse to add more money to my account.my god,!!! wot do u suggest i do now,.thanks.x

            Did you send them the reminder letter?

            If not, send it and if you did send it, then just rehash it slightly and tell them that you have already paid your maximum £10 fee for this information and you will not be paying it again.

            Also tell them that unless they provide you with the information you will commence legal action to force them to provide it to you.

              sorry internet was down,ive got the reminder letter to send to them,ive also received another letter stating that the collection man has been in my area and wasnt able to contact me,nobody has been to my house and they dont have any phone numbers for me.they didnt put any letters thru the door either to say they had been.im gettin really annoyed at how they think they can tell so many lies.would it be worth contactin my local police station over the money they have taken!thank u for u help up to now.its very much appreciated.x

                    hi again,i wrote that letter u told me to do,i gave them a dead line for today and have received nothing from them apart from the usual demand letters,wots the next course of action for me to take.they took the payment for the sar on the 7th may and i still havent received it.thank u.xx

                        Do you mean the SAR letter? If so, has the 40 days expired?

                        If it has, send them this reminder and then sue them.

                        I have formally requested, under the Data Protection Act 1998 full and complete copies of any and all data you hold which relates to me and my entire history with your company. This was communicated to you in my letter of (date you wrote the SAR), a copy of which I have enclosed for your convenience.

                        Consequently I must inform you that you have not yet complied with your obligations under the above Act.

                        Your statutory 40 days for compliance expires (or expired) on ******** and I would respectfully request that you comply with the above Act and send the information that I have requested.

                        If I do not receive the requested information by (7 days from the date of this letter) I will be left with no choice but to commence a county court claim.

                          hi yes the 40 days has expired,i already wrote to them giving them 7 days to comply which was up on friday 18th,will i send them the above and give them another 7 days,how do i go about takin further action.the 40 days was up on the 5th june,as i sent them the first letter and was received by them on the 26th april,thank u so much for your help up to now.xx

                            You might have to sue them for your information. Have you warned them that you will do this unless they comply?

                              hi,i warned them that i would report them to the information commissioner,i copied the letter u put up for me.they well and truely taking the **** with me.all i keep getting off them is warning letters that the removal van is in the area!im bloody hoping that they do knock on because ill let rip at them for all the messing about that im having to do.lol.x

                                Ok, well you need to decide whether you want to sue them or whether you want to report them to the ICO.
