  • how to enforce court order on bailiff company?

    hi
    i have received judgement at court for a bailiff company to repay the money they had taken from me. however they are not playing ball.

    does anyone know the best way to enforce judgement on a bailiff company in order to recover money back from them?

    How much is the judgment debt for?

    There are a number of courses of action you may take in order to recover the money, in particular since the sum is the result of a court judgment.

    Depending on how much it is, you may issue an N323, Warrant of Execution, or if the debt is greater than £600 you may choose to transfer the judgment to the High Court for enforcement. If the debt is for more than £5,000 then you must transfer the judgment to the High Court for enforcement. If the bailiff company are "Limited" then you may also issue a Statutory Demand, provided that the debt is greater than £750.

    Thus you can see there are a number of ways to enforce the judgment and get paid, but first, how much are you owed?

        In that case, the best course of action is to issue a Warrant of Execution. The form you need is an N323 (request to issue a warrant of execution)and which can be found here.

          Can I just ask was the action to recover the Bailiffs fees taken by you through the County Court? Small claims track? I have recently issued a claim through money claim to recover unlawful fees from a Bailiff Company. Their Solicitor has written to say this is not the correct Court and if my claim proceeds he will be able to get my claim struck out resulting in a costs order against me. He is insisting that I withdraw my claim and the only remedy open to me is by filing an N4. Can anyone tell me if this is correct or not please. The Bailiffs were acting as an Agent for the Council in the recovery of a PCN debt.

                Find out where their Head Office is, take down the registration of the car parked in the "Director's" bay, ask a friendly Police Officer to do a sneaky PNC check on it, then if it comes back as a company car go slap a clamp on it!
