  • dodgy parking fines 3 years old?

    ok, it's my first post so be gentle

    the basics are as follows:

    there is a car park that is covered by one of these funny companies that take pictures of people who go across them and send out fines, uk parking control ltd
    seeing as someone was blocking the car park, we had to do some manourvers to get across it to get to the premises that i was going to, it's a builders yard but you've got to cros the neighbouring car park to access the entrance to it
    the first ticket i got stated that there was a fine of £150 that had to be paid as i was parked in the car park without permission
    the picture they sent showed me with the reverse lights on and the brake lights on waiting to back out of the space i'd pulled into to let the other cars/vans out
    so i wrote back saying that i hadn't parked
    they wrote back saying that there were plenty of signs up so i had to pay the fine
    i wrote back saying that there were no signs, only one that said if you parked illegally you've get clobbered with a £75 fine, not the £150 they were charging me with
    they wrote back saying that if there was no additional evidence to proove i wasn't parked then the fine stood
    i wrote back asking them to provide addition evidence that i was actually parked
    the next letter was from hunter forrest and co (on behalf of ccs enforcement servies)saying that the total fine was now £153.50
    so i wrote back to them to say that there were no grounds to issue the parking ticket in the first place
    they wrote back to me asking for further details in writing
    with a phone number to contact in case there was anything that was unclear
    tis was dated 30th jan 2008
    i'm aware of speaking to someone at the time and they agreed that there wa no case to answer and that i would recive a letter stating this
    yesterday morning i got a letter from ccs saying that the outstanding payment needed to be paid in full by the 11th or they would take legal action

    right then, what do i do?
    pay up?
    do i wait and take it to court?
    do i wait and they take it to court without telling me and then come around being nasty?
    soemthing else?
    i've asked in several different fourms but the basics are that i wasn't parked so why should i pay?
    if it cgoes to court i feel that it's going to be a win for me

    but after reading some of the story's about certain ballif companies, it doesn't seem to be easy to stop them once they get on your case

    which is why i've turned to you folks to find out the best course of action

    i've read a few of the posts but i can't understand what some of the legal stuff means so would like a nice simple answer if that is at all possible

    This is private parking and has no legal basis.

    If they haven't taken legal action after three years, what makes you believe they will take it now?

    They simply want you to pay up.

      Stop communicating with them, ignore everything they send you no matter how threatening they seem, other than stamped court papers (there is a 0.00001% chance of this happening) UKPC never go anywhere near a court.

      Simple enough?

        no letters?
        nothing?

        seems that ukpc also have a bit of a reputation, the ccs links i punched into google bought me here so i think that's enough

              got a letter from ccs this morning telling me that they were sorry they'd sent me a letter and they were passing it back ot ukpc

                Excellent. When you start getting letters again from UKPC - ignore those too.

                  even though it's only been a few days, it's been very helpful to have a site like this and others where peole can discuss the legal sides of issues such as these and feel that they aren't the only one stuck in these sorts of predicaments
