    hi everyone just a quick one,i went bankrupt in december 2008 and one of my debts i took into bankruptcy was my council tax now almost a year later i have started to recieve letters from rossendales(notice of bailiffs attendance magistrates liability order/distress warrant) blah blah blah i spoke to the bailiff and told him this but he said something about it being out of date where do i stand on this matter HELP

    Did you already have a Liability Order for your Council Tax?

    So was the whole of the Council Tax taken into the bankruptcy?

      hi not sure if you got my reply computer went funny but i had no liability order and yes the whole of the council tax was taken into bankruptcy the first i knew about this was a letter from rossendales a year after going bankrupt (strange eh) but the letters are going to my mum's address i don't live there i did send a text to the bailiff giving my bankruptcy number and who to contact ie the officer in charge not sure if i should have done tho

        If you had arrears at the time of your bankruptcy, but the council had not yet obtained a Liability Order, then only the arrears at the time of your bankruptcy will be taken into account.

        The whole amount of council tax for the year only becomes due when you have defaulted on the installments and the council have gained a Liability Order for the full amount due.

        So I am unsure as to how the whole of your council tax was included in your bankruptcy order.
