  • Equita Bailiffs

    Equita baliffs have been terrorising me for weeks. i contacted the company who told me i call the baliff on a mobile number. i offered to clear the council tax arrears at £100-00 every 4 weeks by direct debit. he refused and said that he wanted the full amount. im a single working mum and i just havent got the full amount. he then asked me to call him back on the monday ( this was friday) i called and got no answer. i left a message with my offer and also wrote to Equita stating what i had offered and sent them £200-00 to prove i was willing to pay. i have now had a letter from then threatening to enter my property using a specialist company even if i am not there. i know they cannot do this as i have never allowed them to come in the house. i have been advised to offer payment direct to the council and never to talk to Equita unless it is in writing. Im just waitin for the knock on the door and am living in dread. what else can i DO?

    Have read of this guide Bailiff Guide - Legal Beagles and in the meantime, just ignore the bailiffs.

    As you have correctly stated above, if you do not allow them peaceful entry there is nothing they can do except eventually return the debt to the local council.

    As for the threat of using a "specialist company" to break in to your home, I would write a letter of complaint to both Equita and the local council.

      im a single mum of two now unfortunatley unemployed, therfore on benefits, equita have writen once with a formal notice, saying they called last week and i ignored them, at a time which was agreed, i have never spoken to anyone from equita before so never arranged a time, they stated that they have looked through my windows in my propety and seen suficent goods to take, but these goods will not clear my debt, THEY ARE COMING BK NEXT WEEK, im so scared, i try my hardest to provide for me and my children, please they cant take our things away, what do i do, if they come back, and im in my property, or if they come and im not in?

        Fleming, I suggest that you read the Bailiff Guide, the link has been posted by Amy in post 2 above. Then start a thread of your own, giving as much detail as possible, what the debt is for, whats happened so ar etc, and we will tryy to help and advise as much as we can.

        And try not to worry too much. Amy is the resuident bailiff expert, yopefully se will be along to advise soon xx

          hi there ,

          Its my first time on here , so i really really need help !!

          I have been paying equita with an agreement of 109 pound a month on the 18 th of every month , and i have never missed a payment ever with them ! then tonight i came home from work to find a letter deliverd by hand stating that they want payment in full and that i have charges on !! Can they do this when i have angreement in place ! also only two days ago i called equita stating that i will be apying this debt off in full on friday and can i do this over the phone and will this case be close then !! They said yes ! Now is been passed to a baliff !! The debt outstanding is only 300 !!

              yeah sorry i will start from the beginning ,

              Basically i owed rossendale council £1632, but i was late with payment , so it got passed
              to equita !! i was paying the council every month before i realised that it had got passed !! now i have got the debt down to £500 , which i set up a payment plan with equita of 109.00 a month , which is paid on the 18 th of evry month !! last time i paid was the 18 th feb and the next one is due on the 18 tg march ! well i came home last night to find out that i had a letter through the door (hand delivered) that my things will be removed if not pay the full amout (which i work out now to be £245) Equita have broken the agreement and i called then to ask why , they advised me that it is now in the hands of the baliff and there is nothing they can do !! I have only had this agreement since dec which is three months , they advised me it got passed on because of how long that they had the debt ....... 3 monrths !!! i tried to pay this off in full to them but they would not let me!!

              Please help me !!

                If you can pay off in full then do so direct to the council. They cannot refuse your payment.

                    They are not allowed to charge for letters, if they claim they have visited you the charge is £24.50 maximum.
