  • Warrant of Execution help please

    Hi there
I have a bit of a problem i really need some help with please, if possible.

I had WofE issued to me last year and i had to fill in the n245 form to ask it to be suspended and ask to pay by installments.
The court agreed i could pay £10 a month as i am only on Disability Benefit. I was to pay this on a set date each month.

However a month after the Judge decided on the £10 a month my partner was made redundant, so then we were living on even less money than before after everything was paid out. The mortgage alone was £550.
Anyway i managed to find the money each month and never missed a payment, but some months i couldn't pay until a day or 2 later than the planned date due to difficulty getting the money together or having to borrow money from my parents due to not having enough to live on. In December i was really struggling and i couldn't pay till the 24th so i phoned up as usual to pay and they werent answering, so i tried again on 28th after the Christmas break. They said i couldn't pay them and that they had applied again for a WofE and that i would now have to pay the bailiff instead. I foned the bailiff straight away to tell them what just happened and the next day i went to the court to get the WofE suspended and to pay and clerk that works there. He then said you can't suspend a WofE until you get it. They then gave me a n245 and said come back when the WofE arrives.
Anyway the WofE has arrived today and it says i have 7 days to pay up in full or they will come back in 7 days with a van and add a fee of £139. It also says they may have the police present.

So my question is. Can i apply to suspend a WofE for a second time? If so should i explain all the above to the judge. I cannot see anything written anywhere on the WofE that says i can apply to have it suspended, so i am really scared. I am worried sick because this is over 1k and i just havn't got the money. I can't bare the thought of them coming in my house and restraining me while they take what they like. I am disabled and so i won't be able to defend myself or fight back against these men.

Can someone please advise what my options are

    Thank you.

What kind of debt are the bailiffs collecting?

Yes, you can apply to have it suspended again. You should also be applying for either a fee remission or an exemption - I presume you are already aware of this since you've already successfully applied for a suspension of one Warrant of Execution?

In the meantime, you should have a read of this guide Bailiff Guide - Legal Beagles

Hi Amy, thanks alot for responding.

It is a credit card debt. It is actually double the original amount that i used on the card due to the charges they added.

Have you not thought about reclaiming the charges?
