  • non-certificated bailiff complaint

    Just a quick question.

    If a 'Form 4' is to complain about a certificated bailiff what is the best approach to complainning about an non-certificated bailiff.

    The reason I ask is the bailiff in question doesn't appear registered when I do an online search for him. He works for Newlyn PLC :mad2:

    If the bailiff is not certificated, but should be, then the process of complaining is the same as if he were certificated.

    It is worth bearing in mind that the list may not be completely up to date, so it could be worth checking by telephoning the Ministry of Justice 020 3334 6355

      In your opinion if a bailiff works for a DCA collecting monies on behalf of a council claiming for a road traffic contravention should they be certificated?

        DCAs are never certificated; this is purely for bailiffs and then only when collecting certain debts.

        Are you getting confused between the two?

          Maybe :tinysmile_cry_t:. I know that DCA's do not need to be certificated, but unsure whether the persons claiming to be bailiffs are in fact certificated bailiffs or merely debt collectors using the term 'bailiff' loosely?

            It would be a lot quicker if you told us who these bailiffs/DCAs are and exactly what they are attempting to collect.

              DCA is newlyn plc and the colector is a mr jay o'hara. As mentioned in a previous thread I have a bit of a dispute with both there handlings of the case and just want to know the best way to complain.

              The fine is for a road traffic contravention. Parking in a restricted area and caught on cctv.

                Newlyn is a firm of bailiffs, they are not DCAs.

                With regard to your other thread, I thought you were sending a SAR and awaiting the outcome of that before proceeding with your complaint - or am I missing something?

                  Ahhh, ok. I didn't know there was a difference.

                  Glad I found this site.

                  And yes, just finished the SAR and posting it tomorrow, was just curious as to the procedures in both cases for future reference in this matter.
