    Edit the SAR in the bailiff guide to suit and send it with your £10 cheque or a postal order. Take it to the Post Office and get a free Certificate of Posting.

    Did you owe in the region of £440 in council tax?

      No it was for a PCN!

      I am a bit apprehensive about sending off for this SAR, as what if they fabricate a bailiff report, and who is to say what is in the report is what actually happened?????

        They are required to keep records, you are simply asking for a copy of their records on you.

        Doing nothing will not make the bailiff go away or just give up on his fees.

          I now they keep records but I believe that they keep records that reflect better on them, just because it is written, doesn't mean it is true or even that it was put together on the date they say, or even what is actually written, is what happened.

          my sister is 16 yrs old and had no clue what was going on and if they came round when i was out then she would have opened the door, if someone had come round

          I am not going to leave it I am writing to the council, as well as my local councillor and the complaints department at Newlyns.

          I just wanted some advice on whether or not they can do what they do.

            hi im having problems with newlyns over council tax , contacted my local council as they have to regulate how newlyns deal with their clients and have been told by coucil and newlyns there is no charge for asking, for the information that they hold on you, i am also having to fight charges for bogus bailiff visits, i have sent a letter to newlyns and also given a copy to my council, and the council are investigating also. Have given them 14 days to reply to me, had a phone call from my council and they have given newlyns 7 days to reply to them ! and give answers to my complaints, i have posted a rather long thread about my complaints on here .

              Oh my god these people are unbelieveable, I thought it was just me but I have been charged for 3 visits, which I know they have not been as 2 of them I was here and the other one my parents were in at the time and also for 2 van calls to take goods, again nobody called, there must be something that can be done, they are a bunch if liars and the staff there are so rude, particularly Alex. They also state that letters have been put through the door, it's a mystery that they have put through 3 yet I have never seen 1

                Hi this is my first post but have been getting advice from here for a few weeks.
                I too have a problem with Newlyn. They have been collecting a council tax debt that was £1980. I have paid £1850 to them and the final balance of £130 direct to the councilover 5 weeks ago, as I was advised to do. I have written to both Newlyn and the council at least three times with copies of these receipts but have no response from either and am being hounded by Newlyn most days.
                Newlyn have charged me over £700 in fees for visits that have not taken place. I have sent an SAR to them and they have responded and stated that trhey do not keep records of visits. In my screen notes my door is descibed but it is an incorrect description. None of the letters are recorded in the notes in my SAR response but they have all been reeived as sent by recorded delivery or by email with a receipt attachment.
                They are continuing to add charges to my account.

                What can I do to stop this?

                  What you should do is get those fees back. It is absolutely impossible that you have legitimately incurred £700 worth of fees for a council tax debt of less then £2k.

                  In order to get this money back, you will have to get tough, see through to the end and it very possible involve court action - are you willing to do this?

                    Haven't had time to read the whole thread but quickly got the gist of it. I think Newlyn are nothing but a bunch of con merchants. They claimed to send me a letter I never received regarding a PCN, the Council who employed them (incidentally my employer) state that the print-out from Newlyn also says they visited twice on 05.06.10 one of the visits being at 2.30pm........no card was left and Newlyn are now denying ever visiting saying that the Council viewed their movement notes from the Council office (apparently the can) and must have been mistaken. A friend of mine was also clamped by Newlyn for another Council and they state they sent her 3 letters none of which she received. Both of us have got Stage 2 Complaints lodged with the relevant Councils.....................but watch this space, my friend works for the Mirror Group Newspaper and a journalist there intends to run a news article when she gets back from he hols, and wants to feature both of our cases as I have various other issues with Newlyn regarding the clamping of my vehicle.

                      Yes absolutely. I actually haven't paid the fees only the full amount of council tax but they despite this they are still hounding me for the fees. I was home on at least three of the occaisions that they say they have visited and they definately did not come. On Monday this week they sent a letter saying they would visit today between 7am and 9am, for which I would be charged. They again did not come, but my account is showing another fee.
                      What should I do now?

                        you don't need to do anything at all regarding this....they will not admit this but i used to work for them and you are only ever legally bound to the council tax debt itself which has (as you said) been paid to the council.

                        you do not legally owe the debt to Newlyn and don't let them tell you different. after all it makes sense as the council are only interested in collecting their money and aren't interested in helping the bailiff collect there's.

                        also this is for everyone. when you are paying money to Newlyn the money is firstly deducted from the actual council bill not the fees incurred by the bailiff (which are illegal anyway). this means that you should look on the letter they send you to find out how much is actually owed to the council, set an arrangement and go along with the amount they claim then once the councils amount is paid totally ignore the bailiffs as there is nothing they can do.

                        if everyone pulled together and did this i would guarentee they would go out of business.

                        so my advice is ignore them. there is nothing they can do. and i would guarentee you that absolutely no - one will attend you property because they know they can't as it would be illegal when you only owe their fees. it might as well be me asking you for £100 pound.

                          This is my first time posting on here. I too am having some difficulty with Newlyn. I received a parking ticket back in 2008 which I appealed against again and again but ultimatley has gone through the Northampton Court and is now a debt payable to Newlyn. They have sent a letter to say that the amount to be paid is £350. I assume this includes court costs, from reading the earlier posts I can send a SAR to get a breakdown of the costs .
                          My main issue is that when I phoned i was told this had to be paid in full in 28 days. Can they do this? If I can not afford it, surely they must accept a payment plan.
                          I do not have the funds avaliable to pay it in full, so what will happen next. Will they send a person to my door. Will they arrange a payment plan or will they be here to collect goods. I am concerned as I have a car (old and battered) but would they try to remove it if I can not find the money in full in 28 days.

                          Any advice please.

                            They are able to give you six months to pay, but they are unlikely to do this without a fight because they want their money now.

                            Have you complained to your council about them passing a disputed parking fine over to the bailiffs?

                              I shall phone them and insist on spreading the bill, hopefully that will work. What also worries me from reading this forum is that my debt will keep increasing with phoney charges. Is there a minimum i can pay. is only the original fine really due?
                              I phoned them upon receipt of a text message saying that baliffs were due to visit my property. At that point they told me I owed £350 and that I had only 28 days to pay.
                              I asked for the amount and there details to be sent in full by post and I have not received anything yet. I guess they're hoping I forget so can add more charges!!!

                              As for the council, the ticket went through Northampton Court as I had not paid it and was disputing the ticket. So the court insisted it was payable and it was then past to baliffs. I phoned the council and was told once it had been passed across to the balliffs it was out of their hands.
                              Is this correct procedure?

                                Hi, I have had dealings with Newlyns since 2006, I am constantly playing catch up with my council tax. They have clamped my car three times over the years and I have had numerous default charges, I would say over four years I must have incurred at least £1200 in charges. They are now back on my case, I have today called the council and they were no help at all. I cannot believe they want me to pay £250 per week to clear the arrears, obviously I can't manage this, I am already paying them £40 per week for two other cases. I now have no option but to put my car into my husbands name and when they visit I am just going to ignore them. I know I will get more charges, but hopefully they will eventually get fed up of trying and send it back to the council, does anyone know roughly how many times they will visit before they send it back????
                                Any advise gratefully received
