    Hi Guys

    We have had bailiffs coming out to my property for the last few months due to my wife being involved in a car accident and loss of earning falling behind on our council tax.

    Tonight i have sent emails to the account directors at equita explaining the situation

    here is what i wrote

    I am writing to you concerning my council tax for 07/08
    I unfortunately got into arrears with my council tax in 2008 due to being off work after a car accident. Our account was passed to yourselves and we had an agreement with yourselves for £100 per month.
    Unfortunately due to financial difficulties we again got into arrears and a bailiff called at our property around April time. We set up another arrangement to pay £100 per month. In July i lost my job so when i called to make my payment it was 2 weeks late. I was told by your office that the bailiff had picked it up earlier that day. I called the bailiff and explained that i had the payment. He said because it was late he needed the full amount.
    Unfortunately as i had lost my job 2 weeks before i was in no position to pay the full amount. I did offer to pay the July's and Augusts' which wasn't due for another 2 weeks. The bailiff refused this. On the following day i went to my local CAB in Solihull who phoned the bailiff on my behalf offering the two installments. Again the bailiff refused.

    I have tried to get the full amount together but can not get a loan or borrow the money. I do really want to pay off this debt and was hoping there was someway of starting another agreement. I have not defaulted at all on this years council tax, as i pay by direct debit.

    If there was any possibility of resolving this issue i would be very grateful.
    I am finding this whole situation very stressful. I have just been told that i am in the early stages of pregnancy and feel the stress of this matter is not good for my self or my condition.
    I would be grateful if we would be able to set an agreement for £100 a month to be paid on the 26th of each month as i know payment would be mad with no exception.

    what i was wondering is there anymore that we can do. We dont open the door to them and talk to them through an upstairs window. I have been told by one bailiff that this is rude of us ...ha .

    they did take down the reg of my wifes car but since then we dont park the car at the property.

    if anyone could give me anymore info i would be really helpful . After waiting and being told that we couldnt have another child by doctors i dont want anything to be stressing my wife out whilest she in the very early stages of pregnancy .

    How much do you owe in council tax? How much do they say you owe, which will include your council tax and their fees? How much of this have you paid?

    You're doing really well, as long as you don't let them in there is nothing they can do. Absolutely nothing, so please tell your wife not to worry.

      they say we owe £1170. now when we spoke to the bailiff in july we were told thats what we owed . then when a diffent bailiff came out last month she said that it was £960 but said that it had gone up to the above sum because of there charges ... weve paid £600 so far. Shes just got so streesed out over this ... i wouldnt mind if we had just ignored it but we have been trying to sort it ....it even got to the point that i was on the phone begging the bailiff to accept the payment but all he would say was that it was out of his hads that Equita would allow a paymanet plan again ... we have tried everything to get a loan but just cant afford to get into anymore debt to clear this one. thanks again steve

      Also i dont know if this help . we have been told by the bailiff that they can turn up anytime they want and climb through bedroom windows whilest your sleeping . We told the lady bailiff that there really wasn't anything of value in our house to which she said they would just take what they thought for public auction and if that didnt cover the cost they would then return after we had brought new stuff and come and take that as well . we do have a w reg fiat punto but as it's not taxed or mot'd she said she wasn't interested . we were just desprate to get this sorted out . i cant see how these people can do this to other people when they can see that you dont have means to pay them in full .

We told the lady bailiff that there really wasn't anything of value in our house to which she said they would just take what they thought for public auction and if that didnt cover the cost they would then return after we had brought new stuff and come and take that as well .
        Scum sucking pieces of ****, I wish one of these *******s would try threatening me with something like that.

          I think you need to consider sending a Subject Access Request letter here Bailiff - SAR - Legal Beagles

          They can actually do this, but only as long as the window is open. If it is closed, they cannot open it.

          This is completely wrong. This is known as Nulla Bona. Simply put, Nulla Bona means that the debtor does not possess goods which if seized by a bailiff would be enough to clear the debt if they came to be sold, so the debt must be returned to the council for collection by other means.

          Get the SAR sent off as soon as you can. I know it's difficult, but as long as you do not let them in and keep windows and doors closed, there is nothing the bailiff can do.

            Hi steve.I ahd this problem to.No mater what you say they dont listen.What i did i got intouch with my local councillor.She was fab.She spoke to them and they let me pay weekly at a payment i could afford
            try this.Local councillors are over bailiffs.So they have to do as they say.

              Thanks guys im going to do the sars letter and get in touch with my local mp . i just need to get this sorted. They just make you feel so worthless . Do they not realise most of the country is in the same situation at the moment.

              can't belive i begged him to take the payment and he refused to accept it . i thought that they would rather have a payment than none at all.

              Goes to show if you work all your working life you get nothing off this goverment. Because i work we couldn't get help with our rent or council tax when these things happened to my wife. yet if we both gave up work we could have had the lot paid . is just not fair !!!

                Hi guys

                just to let you know i recived a letter from equita today

                they have accepted an payment plan so they have called the bailiffs off . we can now pay them £100 a month on my payday .
