  • Moorcroft Threaten Court over Debt Paid In Full to BT

    Morning again.
    A couple of weeks ago I posted regarding threats of action by Moorcroft DCA over an account with BT which we have already settled in full directly with BT

    Despite paying BT directly in full, Moorcroft are insisting we still owe them THEIR fee of £95.53, which was slapped on the first letter we received from Moorcroft advising us they were now involved.

    We have this morning received a "Notice of Intended Litigation" demanding payment in full of £95.53, or £190.53 "if judgement is obtained"

    We have until the 14th November to respond.

    Please see the attached letter received this morning threatening to take us to court.

    Can someone please advise what I should do next? I really do not want a CCJ!

    Am I liable? Should I just pay the £95?

    File it under I as they are clearly urinating into some inclement weather..

    Seriously, Moorcroft have TWO desks, Pre-litigation and Pre-Court, BOTH are meaningless cobblers.

    They CANNOT and will not take action over their own fees, especially when you can show that the original creditor has been paid in full.
    There is NO contractual provision for them to add "fees" in this manner and as such any letters demanding payment for the same are meaningless threats.

      Thanks for that - Surely given the fact that they have no business attempting to collect such fees, their behaviour is illegal in criminal law?

      1. Demanding Money With Menaces?

      OR/AND

      2. Attempting to obtain money by deception?

      Either way, basically ignore and no CCS will be forthcoming/DCA will be calling at my door?

        The important wording here is: We MAY instruct our client, doesn't mean that it's guaranteed.
        That ONE word is enough to avoid any possibly illegal consequences.

        Also, they WONT be sending some one round.
        Remember The Pizza Dude has more right to come to your door than an uninvited debt collector

            Hi again.
            I think I know the answer to this already, but just looking for re-assurance really - Received the attached letter this morning in relation to the original post above.

            Should I be concerned, or is this just more bullying BS?

                LOL that means, as said in previous posts they are trying it on basically. Some indeed would pay up, you have asked for reassurance that all is ok and it is.
