    Hi all
    Looking for some help with the above. My daughter got aparking fine and i paid it for her. I paid to the wrong council and it all went wrong from there. one morning baliff stops me as i goout to work and hands me a letter for my daughter. Put it in my bag and forget all about it.nextmorning same baliff turns up but this time knocks daughter out of bed, clamps car and says she needs to pay £432. After an argument andlots of tears my daughter gets her boyfriend round and he pays the money. they said theyhad sent letters but we had none except for the lettershe handed me the day before. This was a couple of months ago and i dont want to let it go. Maybe i will have to though thats what iwas hoping tofindout from the knowledgable people on here. Anyonepoint me in the right direction?

            How did you pay the wrong council? If there was no bill to pay, on what basis did the wrong council accept the money and did you obtain a receipt for the payment?

            If the council to whom the bill was due did not get paid then they would have had no reason to do anything but engage bailiffs to collect the outstanding debt. From that point of view at least, they have acted properly, notwithstanding the missing bailiff letters. Once the details of the SAR come back, you may take further action, but the issue here seems to be that you paid the money to somewhere other than where it should have been paid. The right council did not know this and even if they had, they had not been paid, so what would you have them do?

            On the subject of fees, which is doubtless the bulk of the £432, unless the fees have been actually and necessarily incurred, they are unlawful and can be recovered. Again, once the details come back from the SAR that you have sent, you will be in a better position to decide what to do next.
