• Help with JBW

I am new to all this, so please bear with me.

Back in January of this year I allowed a bailiff entry to my property and duly signed a notice of distress and inventory.
This was for a £283.65 council tax bill. once the bailiffs charges had been added on this amount suddenly became £521.48
Due to my circumstances the bailiff agreed that I could make payment of £60.00 per month.
I have been paying this amount for the past eight months. Today I phoned him to make what I believed to be my final payment of £41.48 only to be informed that I still owe £198.00.
How can this be when the notice of distress quite clearly says.
Total Amount Due £521.48.
Can they add on extra charges like this.
Please help the bailiff is coming to see me tomorrow. and I don't know where I stand.

Hello Karen,

What has the bailiff told you with regard to this £198? What has he told you it is for?

Prior to the amount of £198, do you know precisely what charges have been added to your account and what they were for? Be specific if you possibly can as there are rules on what a bailiff can charge for the recovery of council tax and they are quite rigid.

He has not told me what it is for. He just said that he would come to see me tomorrow.

The charges added to my account were as follows.

£42.50 Previous visits
£33.33 Levy Fee
£12.00 Walking Posession
£150.00 Attendance Fee

Re: Help with JBW

The costs for attendance with a vehicle to remove goods after a levy has been made (signed walking possession) are stated to be 'reasonable'.

If a van is used by a bailiff to attend it will not be used to visit one property, it will visit many so the costs and associated fees should be divided accordingly. When the bailiff visits with you tomorrow ask him how he justifies charging one person £150 for a van when you can rent one for £30.

This is over and above what he is allowed to charge you as is the extra £198.

How did you pay and do you have a record of the dates these fees were applied?

Re: Help with JBW

Good point I never thought about how much it costs to hire a van.

my payments have been made using my maestro card. and I have receipts for all the payments.
The fees were applied on the day that I signed the notice of distress and inventory.
The first I knew about and extra £198.00 was today when I phoned to make my final payment.
It has been such a struggle to pay this off. and I was so happy when I phoned to make what I thought was the final payment. when I was told about this extra amount I could have cried.
What I am worried about is can he remove goods from me to cover this extra amount, even though it is not mentioned in the notice of distress and inventory ?
Please excuse me if I sound a bit dippy, but as I said I am new to all this and am feeling very stressed now.

Bailiff arrive this morning. He said that his office had told him that I had missed payments.
Luckily enough I receipts covering every payment that I had made, These receipts did indeed show that I only had one more payment to make. The bailiff then took the final payment from me and wrote on my receipt outstanding balance nil. Hopefully that is the end of the matter, I wonder if these people have any idea of the stress that they cause due to their incompetence. Thanks for the advice given on this it is nice to know that you are not alone when dealing with these people.

As you have paid the bailiff off this is the perfect scenario and time to chase them for the overcharges. As you have paid there is no comeback and there is nothing stopping you from issuing a n1 claim against jbw for the return of unlawfull fees alternatively you can even do a bailiff complaint. i suggest you do a sar and then follow it through.
If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them. I am hopefully going to start a degree (law) from october. If you think my posts are helpful or are guiding you in the right direction do show your appreciation by giving me a green blob.

Hello, My Brother has received a notification from JBW asking for immediate payment, he has hit financial difficulties but i can pay off in installments for him, on his behalf. ie charge is £396.66, I can pay £150 and installments after.

Please can you advise if this is possible at this stage as I am willing to pay it for him but obviously not in one go. Any advise would be welcomed.

Please can you tell me if it would be advisable to contact JBW via email to enable proof of contact rather than telephone.

Kind Regards

From Cin a worried sister

Hi Cin

would be best if you started a thread of your own. Just click on the "New Topic" button at the top of the Bailiffs forum. Can you put in as much detail as possible - what is the debt for, is this the correct amount, basically what is the story so far. Then we will be able to advise better.

and welcome to Beagles.
